Private puchase and making payments its going sour between bolth parties
Hi I recently started making payments on a Chevy truck the seller is a or was a friend when I got the truck he handed me the title and I went down and transferred it into my name the he had just bought the truck and hadn't transfered it into his name yet... but I never signed anything No contract or anything only on good faith now he is threatening me and trying to get me to give him the title until I pay it off. I told him No then he got really mad and demanded an affidavit in Liu of title until I finish paying it off I am a good person but just don't trust many people... so I offered to sign a a statement that way he has some ground to stand on but he just won't be happy with that I don't know what to do any suggestions????

Tell him he can always take you to small claims court if you stop making payments.

Since the previous owner apparently never titled the vehicle in his own name, he's got no proof that he ever even owned it. If you quit paying him, it's his word against yours. I can fully understand why he's upset.

If I was in this situation, I'd go get the vehicle registered in my name, then take a loan out on it at the bank or credit union, and pay off the friend with the loan.
Guess it depends on how much you value the friendship. If you decide to keep making payments, make sure to keep track of every dollar you pay. With nothing in writing, he/she can only threaten and can't take any official action if the vehicle is in your name.
