Damn Airlines (and Legal System)

Goddam. I hate capitalism sometimes...

This is a 2 part story, so it's prolly gonna be long but here goes...I appologize in advance for the profanity:

A little over a month ago, my girlfriend went to Houston TX to visit some family/friends. After about a week of being down there, she was calling me telling me how badly she just wanted to come home, but she was down there for 3 and a half weeks. Anywho, while she was down there, she went to a bar on a thursday night with her cousin. Normally she doesn't really drink (would rather smoke weed ), but she had, according to her, 3 drinks at this bar in downtown Houston. Her cousin got totally smashed, and was in no condition to drive. Anyways, she drove after they left the bar, and being from out of town, doesn't know the area at all. About a block away from the bar, her cousin told her to "turn left here", and she did. Turns out it was the wrong way on a one-way street. Go figure, there's a cop sittin' right there... To make a long story short, she got arrested for DUI, and I got woken up a 2am with a collect call from the Houston jail. So, we had to bail her out of jail, and she's never had so much as a parking ticket. That was on a Thursday, and she was supposed to return the following Monday, however, she had to go to court on the next Wednesday for a hearing. So she ended up having to stay a week longer. It was all supposed to work out, cuz my brother was visiting my parents in Seattle, and I was gonna drive out there, and her airline only flew out of Seattle, so while I was out there, I was gonna pick her up and visit my folks for a few days and then head back to Spokane. So after her court date, she got a stand-by ticket to come home on the next Friday. The fucking airline had WAY over-booked all their flights to Seattle, and she couldn't get a flight on friday. Same thing on Saturday, same thing on Sunday . She talked to a lady that was also flying stand-by trying to get to Seattle, and had been at the Houston airport every day for the last SEVEN DAYS trying to get a flight! Finally my Dad just full on bought her a regular ticket to fly her directly back to Spokane for $400. So she finally got back and all that. For her DUI though, she got convicted, and sentenced to 30 hours of community service, driving school, victims panel (which is where a bunch of people who have been affected by drunk drivers tell their story's in hopes of influencing the DUI offender to refrain from drinking and driving), and she has to visit a probation officer every month for the next six months...



But the kicker is:





SHE HAS TO GO TO FUCKING HOUSTON TO DO ALL THIS SHIT!!!! ONCE A MONTH FOR 6 FUCKING MONTHS!!! SHE DOESN'T EVEN HAVE A FUCKING JOB!!! NOW I GOTTA PAY FOR ALL THIS SHIT!!!

Okay, end story #1. Begin story #2:

So, she has to go back to Houston for her community service and to visit her probation officer, etc. for the first time (she's actually down there right now). So, she cashes in her IRA that she got when she rolled over her 401K so that she could pay my dad back for the ticket he bought in story #1, and also purchase another ticket to Houston for this month. So she bought a round-trip ticket on AmericaWest airlines and was supposed to leave on August 23 and return on September 3. That ticket cost $252. Then, she realized that she actually needed to be in Houston 2 days earlier so she could get her drug-test done on time. So, she calls the airline to move her out-bound flight up by 2 days. They said "Sure, we can do that... it'll be $100 tranfer fee, plus the difference in ticket price ($180)"... THAT'S MORE THAN THE ORIGINAL FUCKING ROUND-TRIP TICKET JUST TO CHANGE ONE FLIGHT!!!!!! So, we're like "fuckit" and we bought a $99 one-way ticket from Southwest airlines, and she would just use her round-trip ticket to return on the 3rd of September. Then, the day before she left for houston (last Tuesday), she called AmericaWest airlines to let them know that she wouldn't be on her scheduled out-bound flight, and those pole-smokers told her that if she didn't use her out-bound flight, her return-trip ticket was void. So I got on the phone and talked to the supervisor trying to get things straightened out, but he was an ass, and wouldn't do anything. He told me that they could sell me a one-way ticket for the return trip for $250 because "you can't use a round-trip ticket as a one-way ticket". So I said "well, does that mean that if I used the ticket to go to Houston, and didn't use it for the return trip that you guys would try charge me more money?". I debated with him for a good 15 minutes, but he just persisted with being a dick, so I got his name and the name/number of his supervisor. Then, he got tired of me, and interupted me, saying "Is there anything else I can do for you?" really rude. I told him "Yeah, you can EAT MY ASS!" and I cussed him out for being a prick. The next day, I called his supervisor, and she did the same shit, so I told her to eat my ass. Every day since then, I've called both of them and told them to eat my ass. :finger:

So, to make a really really really long story short, I've got to buy ANOTHER damn one-way ticket for her to get back! Let's see... thats about $900 bucks this month on plane tickets. God I hate these fuckers, and I have to deal with their crap for the next 6 months! Stupid legal system shouldn't have made her go back to Houston to do this shit.

Wouldn't it be easier/cheaper to hire a good lawyer and fight all that shit to get all the comm. service and shit transferred to Washington?

Actually, she called me the other day, and apparently, when she went in to fill out her paperwork for comm. service and whatnot, the lady that was helping her was like "You're from SPOKANE, and they're making you come down HERE for all this?!?!"... Anyways, turns out this lady is going to give a friend of hers a call (don't know if he's a lawyer or what), and will probably get most of the stuff dropped (no community service, no victims panel, no driving school, and only 1 probation visit which she is already there for). The lady said she's not promising anything, but she's gonna try, which is hella cool of her. Now, my girlfriend just has to pass her UA, or she goes to jail for a year, and she smokes weed like no tomorrow...

Just a thought

DUI isn't a federal offence in the US is it?

And the licence was issued in WA not in TX I presume.

Hypothetically, if she doesn't attend then presumably if she never goes to TX again (or alternatively isn't picked up in TX by a police officer/bailiff) then she can't be arrested in WA or any other state for that matter as any warrant issued would only be in force in the jurisdiction of TX.

Presumably she didn't need to post bail so I'm guessing that no bondsman is after her so no bounty hunters wanting to relocate her to Texas.

Not that I'm advocating breaking Texas law or any thing like that... just wondering about extradition for DUI is pretty unlikely...

I guess the only other thing would be insurance...

Well, she did have a bail, but once she went to court, it was quashed.

But I believe in doing what's right, and there was definitely thought about not going back, because nothing would show up on her record here, but that just isn't right... I'm just pissed that she has to go down there to do this shit. that seems really excessive!

Sorry to hear about all the headache this has caused. If someone waits on standby, then they are just pushing their luck. I wont get one of those. I want my ticket so my seat is reserved. With the cutback in flights, standbys are a lot harder to get.

She wasn't drunk. She blew a .04 on the breathalizer. But, she was unable to keep her balance during the field sobriety test. She's not exactly the most coordinated person I know... So it was BS to begin with, but based on the fact that she turned the wrong way down a one-way street and wasn't able to keep her balance, they were able to convict her despite her being well below the legal limit (.08 BAC)... And then on top of that, they force her to go back...

The reason she had a standby ticket was because she had a friend that works for the airline get it for her super cheap, but it had to be stand-by... Just trying to save some money, and I've never heard of anyone having that much trouble with flying stand-by...

Ever since 911 the airlines have cut back on the number of flights. Thats why the stand bys have had a harder time getting on.

The whole deal does sound boned from the beginning.
