Delsol Totaled Citys Fault

My girlfriend and I were driving down a poorly lit street with the speed limit of 40MPH . We all of a sudden hit a Gravel/Dirt pile of atleast 1 foot high. It sent the car launched into the air and upon smashing back on the ground it destroyed the axle and shattered the transmission. But it was still driveable. So we drove it home and then took it to a mechanic the next day. Turns out it needs a new axle and whole new Auto Tranny. (friend of her family) Quoted in at 3,000 . Thus its totaled. Does that sound too much or too little for a new axle and new tranny with full install? Also She filed a complaint against the city for them to pay for it, afterall it was there fault for leaving that in the road and no signs or anything. Will they pay for it?

what year is it? Try and go on ebay.com. 3Gs is way to much, i can buy a 93 civic in good condition for that.

its a 95 del sol base model with 75k miles tho! lowwww! They are so rare around the massacussets area too. The lowest we can find with like 100k is around 6 grand. So she got it at a steal for 5k with 75k miles perfect condition. Were just pissed that she totaled it, and its the citys fault. my question is, are they going to pay?

I'm sure you could try and talk to a lawyer and get a free opinion oh what they think. Getting money out of the city would be fun.

well, DelSols are rare in the first place. getting money out the city is very hard. maybe get a lawer, or go to other mechanics. because i belive cheap civic tranys will fit delSols, cause they are like the same engine. A D/B - 16/18.

Talk to an attorny. I should legally be the city's fault in that situation. I would guess you'd have a hard time getting money out of them alone, but you can try. I'd get a lawyer. A good lawyer should get you the money you derserve for sure. That being said, you could then go iut and fix the del sol, since it's not out of your pocket. I know of people who have hit a pothole and it shatrtered their rim, and the city or DOT had to pay the cost. I would try and talk to the city, and if it is unsuccessful get an attorney. Either way, you coul dhave been killed. They are lucky you didn't get hurt, where they really could be hit up for damages. Go talk to an attorney, and get the money you derserve. They should have to pay, and a good attorney will make sure they do.

Yeah, the city should pay for it. If it was a written estimate, maybe the mechanic is going high on the quote (because you mentioned hes a family friend) to get her (or himself) some extra cash. When it's someone else's fault, everyone I know gets the highest estimate and then goes to the place with the lowest to get it fixed, and they end up with extra cash.

yea exactly. My GF is going to call a lawyer tommorow. I mean totaling her car because of the road is just plain wrong. Honestly It felt like hitting a wall it was so bad. Yea luckily we had our seatbelts on. There was no exterior damage, just the tranny and axles saw all the damage. It jetted us forward. Thanks guys tho.

how do you miss a 1 foot high mound of dirt? I can understand if you were in a lifted truck or something, but a del sol???

it was poorly lit and there was a car in front of us about 30 feet. We saw him launch into the air and then we did too. It was instant.
