Question My car was totaled and its not my fault!

I have an insurance question. My car was just totaled in an accident and the guy that hit me ran off and left his totaled car at the scene. I am sore and bruised but my car is totaled (according to my insurance company). I have unisured motorist coverage so my insurance will pay me what my car is worth. problem is that my car was a 98 honda that i jusrt paid off. it only had 60k miles. the kelley blue book value is $8700 but i was planning on driving that car for years (with out a car payment). There is no way i can buy a replacement for $8700. How can i get a similar car without paying more? Can i make my insurance replace the car? I am pretty sure the guy that hit me is uninsured. I am also paying for a rental right now as i didn't have car rental insurance. Do i end up paying for that if he is uninsured? I would hire an attorney but it would just cost me more$$$. Any ideas on help for this? Maybe a website with answers? thanks

If the other driver has insurance then your insurance company will sue his and get their money back, if not then you have to sue his insurance company. If the other driver is uninsured then your insurance company will have to sue him to get their money back, and you will have to sue him for your pain and suffering. Get a laywer for that part, they will work with your insurance company, and finding one who will take the case for a percentage is pretty easy, nothing comes out of your pocket. Good luck.

you cant find a good car for 8700? seriously man thats more than enough to find a decent car to last a few years. It might not be as nice as the one you lost, but theres nothing you can do about that. You can sue the other guy for reinbursement of your rental car.

Maybe you should do this, go find a nice used car, it doesnt have to be 8700, it can be more. Use that money for a down payment and take out a long lease, that way you have a very small monthly payment. You can find a good used car for like 10-15G's. With a nice 60 month finanance, your looking at like 60 bucks a month for a car payment.

Man if your car is worth 8500, thats enough to buy a car with lower mileage for about 1500 more. Just look around for a new, used car and stop renting.

Question

My dad had the same thing happen years ago. They gave him peanuts for his car. Ask the insurance co to find you a car like yours with the same miles etc for the $8500. See what they come up with. Maybe they will recheck their figures but keep after them.

Yea the insurance company will tell you to fuck off if you do that. I don't get this. Are you in a "no fault state" i.e. NY,FL,etc...? Because if not, and he was "at fault" then his insurance(or himself if he doesn't have insurance) is required to pay for the car, and then you can take him to small claims court for rental car fees, and health care costs, etc..(you can and should do that anyway, regardless of the state you live in). His insurance should pay for it because that way you won't have a claim and then your premium won't go up. I'm just having a hard time understanding all of this. It was a hit and run, that automatically makes him at fault, and if he left the car then the plates should be on it. That means the cops can track him down really easy and you should be all good.
