I've always seen that as normal behaviour.Do we really need a shitload of legislation to enforce it?

Not in my opinion. I'm also a smoker and have NEVER had any sort of problem with anyone around me because of it, and I live in California where they seem to be ultra sensitive to that sort of thing. Common sense is what's needed here from both sides, legislation IMO almost never fixes what's basically a social issue. Though it can cloud the hell out of it, generate more ill will and basically become a major nuisance (as I think it's mostly done).

For most folks, no. But, unfortunate as it is, there are always folks that don't care about those around them and will do as they please. The laws are in place so that restarant, bar, pub, etc. owners can legally deal with them.
