red light running camera...

While I was waiting to turn left, a small truck stalled in the oncoming lane opposite me in the middle of the intersection, he was now blocking me from turning left. After a while the red light running camera flashed, afterword he restarted his truck and backed up into his lane. Before this I was waiting for him to go through the intersection so I could turn left, but he stopped in the middle of the intersection instead, then his truck stalled, thus blocking me from turning left until after he backed up into his own lane. Will the red light running camera cite me (give me a ticket) or him? The light had changed to red for him as he was stopped and stalled in the middle of the intersection.

Re: red light running camera...

You might have to wait and see if you receive a ticket in the mail to answer your question. The area I live in does not currently use red light cameras, so I am not sure of the timeframe from the date of the incident until you receive notification via US Mail. You might check with the local police about the timeframe involved, and ask them about the situation, and what occured and see what they say. If you do receive a ticket, you could go to traffic court and explain what happened, and see what the next step would be.

I guess I also could have put my car in reverse, backed up in the intersection and then gone around him. But instead I just waited for him to move his truck out of the way, by this time the light for myself and him turned red.

I also read this at...
http://www.trafficsafety.com/pss/faq.html

Quote:
What is red light running?
A violation occurs when a motorist deliberately enters an intersection after the signal light has turned red. Motorists inadvertently in an intersection when the signal changes to red -- when waiting to turn, for example -- aren't red light runners.
Since I was inadvertently in the intersection when waiting to turn left, maybe I won't get fined.

Re: red light running camera...

In Ohio, The state classifies thes RED light cameras as a civil pently, but they can run up to $100.00 the news station did a story about the cameras here in Toledo about the number of people paying the fine, out of 15,000 tickets only about 1,000 were paid. when they announced they were going to take people to court a lawyer put a large add in the paper for FREE assistance, about 8,000 people showed up to court. the attorney pled NOT guilty on behalf of all 8,000. well needless to say, the courts didnt have time
nor the money to handle 8,000 people for a speedy trial, so the all got dismissed.

Re: red light running camera...

You should be ok. If worse comes to worst you can always go to court. Good luck.

I am sure it varies state by state, but in washington it is only running a red light if your rear bumper is not in the intersection by the time the light turns red.
