Unhappy My 1st Ticket

Well I was on my way home yesterday when my 95 5.0 started to get hot...... I was literally 2 minutes from the house but I didn't want to risk anything getting hurt so I pulled over in a parking lot and evedently I just had to pick the one across from where a cop was setting and I got out and opened the hood and was looking at my fan to see why it was not coming on and when I went to turn the key back on there he was!!! He asked me what the deal was and why I was in such a hurry and so I told him about the car getting hot and started it to show him what the temp was on the car... He replied that it wasn't anywhere close to being hot so I told him it was near the hot when I stopped and it was still over half way at this time. I told him that I decided to pull over and look instead of running it on home. (If I would have went home he would have never seen me again and for sure not cought me I should Have went) so he got me out and told me he had the right to take me to jail and tow my car so I had better sand over there next to his car and stay quiet so I DID. He searched me and my car and everything that I had and emptied my glovebox and my center console right into my passenger seat. He asked me if I had ever had a ticket before and I told him no. He then said that I had one now and it's about time someone tought me to slow down. and that 64mph in a 30mph zone was unacceptable and I had a couple of options of paying and all that crap you all know how that goes........ so MY DAY SUCKED I should have went on home and he would have never cought me and the kicker is that this whole way down the street I was following a little red cavalier who was going faster than me!!!???@@@####$$$%%%^^^&&&***

That does suck though man! Sounds like that cop was out for ya. They can be pricks, but there are some very cool cops as well.

I hope you realize that he violated your civil rights by not asking to search your car.
technically, unless you are under arrest, he cannot search your car without asking your persmission to do so. secondly, speeding is not probable cause for a search and seizure. So If I were you, I would go to court, and there is a good chance you can get out of it. Especially if he was using a speed trap.

Yea I was going to say the same thing. He can still search your car if you don't give permission but he needs to have probably cause at that point and speeding isn't one.

I have been pulled over for speeding before and been asked to search my car and said no. They cop gave me crap about what am i hiding and why I wouldn't let him search my car. I just told him I don't have to give him permission and if he feels he still needs to then it's his decision. He didn't search it in the end.

N E way.... dude you were speeding, you were going way too fast. Learn from it! Dam I sound like my fucking DAD!

yeah, 34 mph above the posted speed limit is way too much.

like what was mentioned earlier, the cop doesent have probable cause to search your vehicle.

Way 2 fast for that speed limit. Pay the ticket and chalk it up to a learning expierence.

Thats a good story, The only thing is anything over twice the posted speed limit is not a ticket. Thats called a felony in most states.

Sounds to me like he used the threat of arresting you as a tool to render you complacent while he searched your car. Forget the speeding. If your rights were truly violated, the cop comitted the real crime. You didn't object to the search, because you were afraid you might get arrested, right? He's not going to find anything anyway, so I'll just shut-up and save my ass. You should fight this, if you did not authorize the search. You're probably not the first person he did this to.

i've met some incredibly cool cops in my time... over the summer, i was at the local street races, checking out all the sweet stangs, camaros, and firebirds. all of a sudden a cop comes in to the parking lot, which is packed with loud cars and lots of people. my buddy was telling me it was cool, and i didn't believe him. but then the cop got out of the car and started checking out this one firebird, and asked the driver if we were hooking up. a COP asked us, street racers, if we were hooking! and he talked all about how he had a trans am that he was setting up for drag, and how he used to street race before he was a cop. it was incredibly sweet!

of course, most cops who show up in that parking lot or our improvised drag strip turn on their sirens or tell us to go home =D. most running i've ever done in my life

I have a friend that is a cop and he says that if you get pulled over for speeding you should ask the cop to see the radar reading. If he does not have it then he does not have the evidence to give you the ticket. The cop has to prove to you that you where speeding.

yes he did violeated his rights but if they guy with the 95' said no your not allowed to search the cop would have called in a search warrent...its like the implied consent law, that is you agree to take a breath test if you dont take it the cop will automatically write you up for drunk driving...yes i payed attention in drivers ed 2 years ago!!!
