Possible trouble on ebay

Hey guys, remember back in March when I won the auction for the Enzo Ferrari (http://cgi.ebay.com/ws/eBayISAPI.dll...MEWN%3AIT&rd=1). Well its been well over a month and the guy still hasnt shiped it out. I have emailed him several times over this but he just keeps telling me he hasnt recieved the money. I have the money order reciept still but I have to wait untill the tomorrow morning to check on the money order. I have noticed several negative and neutral replies since this and they are all about slow shipping or not recieving what they bought off of him. His username is toy_power_seller, I was wondering if anyone here has bought from him before or if anyone here knows anyone in Hong Kong who might be able to get in touch with this guy since all I get from him is an email here and there. Any help is greatlly appreciated and beware of this guy if you decide to buy off of ebay...

heh that is the reason why i dont buy from out of country. you can try get your money back from the place u got the MO from. u can claim that it has been lost they can check if it has been chased or wat not. better to deal via paypal if you want to do overseas.

use paypal for ANYTHING on ebay. pretty much guaranteed money back if you have a problem. have you filed a claim with e-bay. they will do a full investigation. i bought 3 kits off of the same person. this was last sunday, the 17th. i have contacted teh guy through 2 different e-mail addresses. i have even sent payment which included 18 bucks shipping for 3 models...yikes. he never sent a revised shipping amount. i figured what the heck. i'll send the money and ask him to refund any overages. if i havn't heard from him by this sunday, or i dont have my models. i will file a claim with e-bay....dont let this discourage you from using ebay. always check feedback before you purchase anything. I have YET to get shafted when purchasing off of ebay. i have had nothing but good experiences. you may also want to try asking a simple question about the itembefore you bid. even if you know the answer. that could give some insight to how friendly and legit the seller is. sorry to hear about your luck...and hopefully mine doesn't turn out the same....oh and i used pay pal...i just really want the models. lol

i've bought things from him with no problems.
we exchanged a few messages via ebay message system (of e-mail relay) and the item came no fuss a few days (maybe two weeks) later as was the norm for hong kong to uk shipping.

anyone here know what the postage/shipping situation is like from hk to us?

and yes, paypal is best.
what i don't get is why you sent payment before you got an invoice from him first.

the first thing i do when i win/buy an item is send a message requesting total and i don't send any payment until everything is finalised.

Yep, I've dealt with this guy before, his names Dennis by the way. I've order three kits from him, and 2 have arrived and one is missing. However, I'm in the middle of trying to get either money back or replacement kit for the one which didn't arrive. So far he has been helpful and has kept in touch.

Just keep up the correspondence and hopefully all will be well.

I didnt, I waited untill I got the invoice to send him his payment. I have turned him into ebay for fraud but I doubt anything will be done about it since its under the $25.00 for the buyers protection policy. I just want the kit to be honest since Ive already got the paint and photoetched parts here waiting for it.

Well you just did the worst thing you can do which is to leave negative feedback before ALL attempts have been made to resolve the issue. You have 90 days to leave feedback, so leaving a negative anytime before then leaves you without even that tiny bargaining tool in your armory.

You state in your feedback that you left for him that you have proof he defrauded you, is that the case now? The only way you could have proof is that the money order is proven to have been cashed by him, do you have that proof?

Just out of interest, did you consider that maybe he has not received the payment, and that is why he will not ship the item? I personally have over 1000 feedback on eBay and I can't tell you how many times I have irate buyers moaning at me about not receiving an item when I have not actually received their payment.

It can take as long as 6 weeks for a letter to arrive in Hong Kong or Japan, 2 weeks is average, and I have known it to take 8 weeks.

i paid him straight away for my JTCC accord, he gave me good feedback and praised me for fast payment....5 weeks later, where the f**k (excuse my language) is my damn honda ? i dont know but if go back to hong kong i will track him down and collect everyones models for them (and i'm gonna give him a damn hard slap too!)

I have went through the ebays dispute center & the 10 day waiting period and he didnt even respond to it. I have tried and tried to resolve this without going this far but that seems to be the only way to get his attention. If you have read some of his other 83 negatives and 51 neutrals you will read that the only way the others got the stuff they ordered was to go this route. Also if you read my feedback to him you will see it actually says I have proof that I paid & that I turned him into ebay for fraud, I didnt say he defrauded me, not yet anyway. The only real response I got from him was him asking me to send him the actuall money order recipt to him so he can "check into it", that wont be happening. He even went as far as to say if I send him the reciept he will send me my $35.50 and the kit as a gift, so I told him to show some good faith to me and send me the kit. Then I would gladly send him the reciept and anything else he wants, but he wont do that. He has even offered to give me a refund, the kit and pay the fees the bank fees for either canceling the money order or information as to where the MO was cashed at, but he will only do this if I send him the reciept first. To me that that sounds abit fishy. I dont think I should have to do everything myself since I sent him a picture of the money order already made out to him (which I always do when I pay for something off ebay or buy something from someone). There are still a couple more options left even though I think its going abit to far but I will if I have to turn him into the FTC and the Internet Fraud Agency which ebays offers but I'm hoping that it doesnt go that far

I just wish all of the people who he has done this to would get together and all of us turn him into ebay, maybe once the suspend his account he will get the picture that we are tired of him taking his sweet old time to ship out our orders or not even shipping them out at all. I 'll bet you if the roles were reversed he would sure as hell turn us into ebay for not paying for them so why should we be any differant?

can you send a COPY of the reciept, never send the original though, i use paypal. are there any problems you could encounter by send a copy of the reciept ? possibly could he do something with the copy to "get round" re-paying you or giving you the model ?

and that's the problem with payment through the post.

you can't prove that you sent it, he can't prove he hasn't received it.

and er.... i think only 76 negatives out of 2756 members isn't too bad a record.

I have sent him a picture of the money order reciept but that wont do for him, he wants the real reciept which I am not about to give up. heres a picture of it.

I mean its not hard to see if you look at the date, amount you can see its for his auction. I dont understand why he wont show me some faith here and try to resolve this.
