Maxima Bangs out due to Idiot driver

While driving the gf home, i was sitting @ the red light chillin. I am going straight up the street and am facing a small intersection with one way on-coming traffic. When my light turns green, I proceed....but the black ford mustang (trying to gun it @ 55 in 30mph zone) make a failed attempt at catching the yellow light. I brake and turn away from him to avoid hitting him, but i end up clipping his tail and send him into 2 parked cars. He runs the red light and i avoided killing his dumb ass. But who's fault would it be? Although i hit him, i was merely trying to steer away...

im looking at 4 G's to fix and an aching lower back. If i do win, should i go ahead and go for the skyline body kit or go back to orginal?

u mean during the time this whole thing happened? just my gf. he had nobody in his car. the ppl who owned the parked cars that were hit came out and saw damage to both cars....i had a banged out bumper (main damage to the left side of bumper). it was moderate. His axle was broken into half...scratched and chipped up. dont know if thats repairable for him. I dont have any witnesses, but by the way his car looked, all the ppl gawking at the accident knew it was his fault. but i dont know whether or not the decision would be mine.

ok take a good look at the mustang then a good hard look at the maxima. which car would be most likely of driving wrecklessly? Man this is a tough one. Hope it works out for you.

yea, i called the cops asap. unfortunately, philly cops can be lazy. they took almost an hour to get there.

OK..first things first: WRECKless driving means driving without getting into any WRECKS...obviously NOT what the Mustang was doing. RECKless driving means careless, irresponsible driving.

Now that that's out of the way...

Why are you bothering to ask whose fault it was? It's obvious. We have 2 drivers here:

Driver N(issan) and Driver F(ord)

DriverN was driving under the speed limit, entering an intersection with a green light, as required by law.

DriverF was accellerating way, way over the limit (almost double) through a red light, where, technically, it's illegal to enter an intersection on yellow, let alone red.

Because DriverN was not anticipating cross-traffic at a lighted intersection, he did not see DriverF's car illegally proceeding through the intersection, and as such, DriverN was unable to avoid hitting the speeding DriverF, and redirecting his inertia in such a manner that he impacted some parked cars.



It is completely, totally obvious who is at fault here. Don't think for one SECOND that hitting him makes YOU at fault. That is NOT the case.

13 months ago I was in an accident in my Sentra. I was driving downhill when an 85-yr old man in a Chrysler Big-ass car made an illegal left turn in front of me, abruptly stopping in my lane. There was a car next to me, and because I was in the inside lane I had no choice but to hit him. I braked and honked, and hit him in the rear driver's wheel/trunk area.

I received no ticket. He got a ticket for failure to yield right-of-way and for turning left across a double-yellow.


What I want to know, is did the police write any tickets at the scene, or is this matter going to court? Have they already made any determinations of fault?


Oh, and FYI....this is why I ALWAYS look both ways for idiot light-runners before entering an intersection. If you had been further out in the intersection, and he had broadsided YOU, you would've been killed.

u'll win in court for that one. damn man, he tore the bumper all to hell. im sure hes gonna be gettin sued by thoes ppl who owned the parked cars too. he should jus hope hes got reallly good insurance

your insurance company won't see it like that. you're supposed to be in control of your car at all times. the fact that you hit him, might put you somewhat at fault. you obviously weren't the cause of the accident but they might not see it as 100% his fault.

there were no tickets written at the scene. Only the police report will determine who's fault it was. I went to consult w/my lawyer and he said he would take care of it. I was already stopped at the light and just proceeded to go...although i hit him i dont think i should be at fault. Honestly, i just want my shit fixed. boingo82 makes a lot of sense. U actually sound like a lawyer =o)

Of course, in Boingo's part of the desert, you have to deal with really stoopid people daily.

Sucks about the car...

definatly double check from now on, because as someone said, next time you could die... this time it could have been your girl..
