Need Some Good Legal Advice--please Read

hi. i need some help. i recently sold a car to someone for 4k. never got the chance to change over CA title. i gave him the white slip that i had to turn in to dmv as well cause he was going to turn that in on the following business day. 2 days later he wreckes it. not his fault tho. but he didn't have insurance at the time of the accident. but i still had insurance for it. he called and asked for help. out of kindness i made a claim with my insurance. got and estimate on the car and it was considered a total lost. so i asked him if he still wanted the car and he said no. so i told him that i should be getting a settlement for it and that i was going to buy the car back and then split half of the settlement with him. we agreed. so i took the car home from the collsion place and then i started fixing it. a week later, my insurance sends me the brief description of the settlement. it was only 1600. which meant he would only get 800 out of it. now he wants the car back and that i can keep the 1600. i said sure as long as you pay me for the parts and labor that i have already put into this car as well. the car looks just like how it did before the accident now. we agreed. 2-3 days later he emails me saying that his lawyer sayd that it would be fair if i gave back the car and the settlement for their loss? WTF??? so now he should get the car and the money??? no way, we had already agreed on something else. that he will pay me for the parts and labor and i will give the car back to him. so now im just waiting for him to pay me but it's been a while since i have talked to him. i was nice to him and now he's trying to screw me over. what do you guys think i should do? should i get this afdativ signed and notarized so that i can get the 1600 and the salvaged title or should i just call my insurance and tell them that the car was already sold at the time of the accident??? i really don't want to get in any other kind of trouble as well. thanks in advanced you guys! point me to a lawyer too if you can.

Your post sure is interesting reading , it's sad when you try and help someone and it ends up with you getting worked over. for you to have a claim will that not affect your future rates ?
