This will make all of you mad...my story

Here's my latest story (for those who care). I thought i'd post it now, after the fact, when i have all the facts and consequences...read on.

I was driving on Monday at 3pm (two days before my birthday, might I add), and i was in the number 1 north bound lane at an intersection, first car in the lane. I had been at the stoplight stopped for about 10 seconds, when I look in the rear view and see a big ass 2001 black expedition comming for me. I had a split second, and then *bam!* impact. She nailed me right in the back of the car, going 20-30 miles per hour. There had been some police activity off to the side of the road (some coked up lady had been pulled over by 3 cruisers), and the lights from the cruisers apparently distracted her from noticing me in my civ up ahead of her. So basically, the popo distracted her, and she hit me. The worst part about this lady: She's a fucking mom, driving her shitty ass mom mobile, and she doesn't fucking watch the road; a true testament and example to the fucking inability for women with large cars to drive:

So now the damage: 5,203 dollars to fix my car. Rear right quarter panel, everything in the trunk, and that's just the beginning of it. My car will be at the shop for 4 weeks. I'm renting a Dodge Stratus (which doesn't have a right front hubcap, so i'm currently rolling ghetto style)
Her Insurance company (Mercury) is picking up the tab, rental car fees, and doctors fees for the whiplash (which i think i have, no joke), but it just sucks that i cant prosecute her ass for some "inconvenience fee". I want compensation for having to drive this car around, and be without my precious Civ for a month I didnt ask to be hit. It's her fault, and i want some due compensation and some serious ass kissing to make up for it.

Maybe I'm comming off really harshly, but I can't stand mom-mobiles as it is, let alone an AMERICAN car. Plus, this all happened 2 days before my birthday, and happened when i was on my way to see my manager at my new job (Banana Republic:smoker: ) So anyways, i'll post pics and keep everyone who cares updated. I just hope something good comes of all this. Who knows, if there's chassis damage, or there's about 2200 more bucks worth of damage they find, i can total it, and maybe go out and get my SI

yes, the poor working mother who is probably struggling like hell with her insurance company and has a huge blip on her record as they had to pay tons. who knows maybe they're already having financial problems and the raised insurance rates is going to make things tight for a while. But hell man, let's make her squirm and make her pay even more because you can't drive your car for two months.

You're like the people who would sued the airlines after 9/11 despite the fact that they make up a large portion of the economy and we're in a recession. It's just discusting. She didn't do it intentionally, it was an accident, and you want to make her suffer. The situation sucks, nothing more. Deal with it.

actually, to correct your statement, the "struggling mother" as you call her was wearing Dulce and Gabana glasses and carrying a Prada wallet, driving a top of the line expo, lived in the nicest part of town, and has a personalized tow-hitch set up to carry a boat (she also has a personalized license plate that is indicative of owning a boat). While I can't guarantee you that she's filthy rich, I can tell you that she isn't the "struggling mother" you make her out to be. Also, the accident took place at 3pm. If she were a "poor working mother", i believe she'd be at work, not out cruising in her expo with her nicely dressed son.

Also, her company called me the other day to get a recorded statement about the accident. This was 2 days later, and apparently, they only knew about the accident because my company called them- meaning that she hadn't reported it yet; she slacked.

Also, this "huge" blip that goes on the record is the same size as a small fender bender- When shopping for a new insurance provider, insurance companies quote a rate that is based upon if you had been in an accident before or not; they don't look at how much the previous claim cost them; Lastly, they only have to pay the deductable, which for her company was 250 (and I know this because we used to have their same provider, with the same type of policy), not a ton of other fees.

actually, if I wanted to make her suffer, I could have filed the police report, which would have had the officers to writing her two tickets- 1 for following too closely, and 1 for failing to yield to a red-light. This would have jacked up her insurance far more than the accident, as having two tickets on a record would (traffic school in CA only clears only 1 of em). But I didnt file the police report, so she wouldn't have that stuff to deal on top of the accident stuff.

I understand that accidents and things of that nature are part of the priveledge of being out on the road. Wanting money was the way that I felt about the situation, not a demand. I'm not going to turn around and sue her ass. That be dick, and has never been an option or thought.

Dont make assumptions about people unless you know the situation. Once you GET a car, then I think you'll know about insurance policies and police reports...or maybe you have a car, and know this stuff, and Im making fun of how you acted by being a hypocrite here in making an assumption about you and your knoweldge of the automotive world

well, all i got to say is that you should be thankful that you don't have any mods yet. i can't tell you how many times i've seen people with fixed up cars get into wrecks and insurance refuse to cover aftermarket parts. maybe you shold have tried to get a new paintjob out of this whole thing. teal ;x

Oh i see because she may be wealthy that makes it ok...right...I wasn't making an assumption. Regardless of her income, it's inhuman to want to pursue something. And you never mentioned you never filed a report, from your post you made it out to be as if you tryed everything you could and wish you could do more. So basically you pretended to want to grill her but then did the complete opposite? That makes lots of sense. If you don't want someone to assume something, then don't make it sound as if you were about to do something. That's like saying McDonalds had given you a burger with a rat on it or something and you wanted to sue them! But in reality you threw the burger out and never mentioned it. But if i dont know you didn't even care what would I assume you did?

And actually i have a car, sure it's a minivan (laugh all you want) but it's what I'm stuck with and I deal with it. I have other things to worry about; daddy and mommy aren't paying for my college or anything else for that matter, so im going into the air national guard and the remaining money i earn will go towards room and board and the first 2 years at our community college. Sure I could not go to college and spend all my money trying to make a honda civic go fast and look nice, but then I'd be living in my car, so I think I'll make a living first.

And since you seem to be jumping to conclusions, let me clear the above up: I am in no way bashing civics, nor anyone who modded them pre-college, all I'm saying is given my situation, I would end up living in that very car as i have nothing to fall back on.

I dont want to be part of this, but it doesn't matter who it was that hit him, he has the right to be pissed off.
A few days ago I went to the parking lot where I used to live, and found my dad's Acura all fucked up the ass, and pushed over the cub into a fence. $5000 to fix, $500 deductable, and now a shit resale value. And it was clearly a tall assed pickup because the bumper wasnt touched, and must have been chrome since no paintmarks were left. I hate assholes who drive big trucks and think they all big when they don't even know how to drive. FUCK!!!

yeah or those all steel really old cars. My friend's dad has an real old v10 jag and he was rear ended by a newer pickup truck at about 45 and the entire jag's rear end was in the air. The only problem he had was it knocked the exaust out of alignment. The whole front of the truck was fucked up bad, pretty much gone...

Wow that sucks. I feel for your dad's Acura. And I understand Bryan's point of view and Auke's, but you have to understand something. I've been on both ends of the same ordeal. I've gotten hit and I've hit another car once. Other than what's paid due, there should be no excess. I'm sure the other person was angry too. When I rear ended an Explorer in my Corolla, I completely trashed her rear bumper and all that happened to my car was a crooked headlight and a bent hood. That Toyota held up , I paid for her rear bumper but she started acting like a b!tch, saying her neck hurt and telling me, "What kind of Mexican doesn't know Spanish..." Angry because, regardless of my ethnicity, I didnt' speak my native language.

With that, I told her to report it to the insurance agency, even though she wanted me to pay for her rear bumper without reporting it because she said it was my fault. I know 90% of rear end accidents are the person behind's fault, but I took her to court and won, because she didn't signal that she was turning, she stopped to suddenly for no reason and she yielded to a person exiting a parking lot too suddenly. I wasn't following close behind her but she did stop suddenly.

And on the other end, I got rear ended in my previous car, (5.0 Mustang), by a guy in a Civic who was trying to get me to race. he rear ended me going 55 and I was going 35, the speed limit. I was angry, don't get me wrong, but I figured the insurance bump and the fact that his pretty new engine was gone was enough payback for his wreckless driving, and given that I filed a police report and he had 4 points on his license for one count of speed contest and one count of speeding, he lost his license and the ability to drive for 3 years.

So auke, I understand you're angry, but the law took it's toll and she is paying for her dues. It could've been worse, you could've gotten a hit and run and not taken her plates.

auke1, please take a deep breath and think about this situation. People make mistakes. Nobody is perfect no matter how rich and what type of glasses they have. As S2Corolla was saying, think of it from her perspective. How would you like it if you made a simple mistake and hit her and she couldn't drive her precious expidition for a month. I'm sure you wouldn't like it if she made a big deal over it.

Noting is going to bring back your precious civic any faster, especially holding a grudge over your steriotype of soccer moms and SUV's.

I gotta ask a little O/T question, nervous now when you are at stoplights? I still get nervous when I'm stopped at the stop sign at school. That accident was about 10 months ago. Just wondering if anybody else had this after their accident.

yup, i take it REALLY easy over the 201 bridge from vestal, and now i try to give myself ~3 car lengths.. obviously 2 wasnt enough when a GMC Yukon pulls in front of you and takes up 1.5 car lengths...........

well she's drivin a new expedition.. i think she or the hubbie's got the money somewhere... people who are strugling don't go buying 50 ton fords..

auke1, you have my sympathy. I've been rear ended, and I've also hit someone who pulled out in front of me in a 45mph and stopped in the middle of the road. Both accidents I could do nothing about, and both turned my life upside down for weeks. I don't doubt that you have whiplash. Necks aren't made to be snapped around. Have a doc check it out now while the ins. still covers it, as it will get worse for a few days and take weeks to subside. I can understand your want for a convenience payment. Car accidents can be an incredible hassle..one of the side-effects of my last accident was that I had to spend hours upon hours on the phone with various insurance agencies and car dealerships in a desperate attempt to find a new car. Of course this was during peak hours when they're open. So, at the end of the month I had gone 2.5 hours over my peak minutes, totaling an extra $70. This is in addition to the fact that my first car, my baby, has been totaled, and my neck aches, and I have to find a new car within 4 days, and I have to come up with a down payment, and I missed work, and I can't drive because of the painkillers and muscle-relaxers they're put me on, and etc. etc. etc. The best I can tell you is to settle down, and wait, though it's maddening that your life is seemingly ruined and the person whose fault it was isn't even suffering. It might work out for the best, and you're lucky you're not seriously injured.

To Bryan: I don't give a darn if the "poor mother" is struggling, because of her someone's life is turned upside down and someone could have been killed. Why shouldn't she be paying for it????? I don't care if she really is poor and struggling, she caused the accident, she caused the inconvenience, so don't go throwing her a pity party just becuase of her insurance rates. If she is hurting under her insurance costs, maybe she should try not running into people.
