Philosophizingly speaking, these people, upon thier Second Felony convition, have demonstrated beyond a shadow of a doubt, that they intend to continue thier criminal ways as soon as they can get back out in Society.
I'm talking about anybody with two or more convictions for any kind of Felony. So why are we so willing to let them out of Prison to Breed and Prey on the people who just do not expect to be Mauled by the Malicious Pond scum? Why do we insist on keeping them alive? In Prison? Why not just do away with them? I'd be in favor of a Law that prescribed the Death Penalty for anybody convited of thier next Felony Offence!:grey: I'd make it a Presumptive Sentence. Mandatory. To take the issue out of the hands of the Weak Judges we seem to have. Now dont get mad about my attitude and get on a soap box with a long harraung against me. I'd like to see some Logic in your reply! The Question is "Why" |

For the same reason that we see it as wrong for them to kill, steal etc,etc I guess. The human race is adept at devising complex and sometimes contradictory codes of behaviour to punish itself for breaching."Crime" is no more, and no less, than unsuppressed animal instinct. It is in the nature of carnivores that the fittest, the most ruthless, and the bravest are the survivors.Let's face it....when did you last see a lion that was frightened of going to jail for beating up another lion and copulating with its partner?

I don't think that all repeat offenders are beyond help.
Execution also seems a little extreme.....would you be able to push the button if you voted for a government that supported the death penalty, and you pulled "execution duty"?

Now there's two diverse opinions
Taranaki thinks the criminal is acting on his Animal instincts.
And poor Matty cant accept the Habitual criminal as Bad enough to Execute! Wait till the guy I'm talking about get's hold of you or something of yours, then you'll find it a little easier to make up your mind about his rehabilitation aptitude! I could spring the trap, or pull the switch, and the only reservation I'd make is to see the Trial transcript. Personally, I want a strong conviction, no trace of doubt. (Be sure your right, then go ahead) I'd never hold an execution if the verdict was handed out as a result of a "Sales Job" the prosecutor did on the Jury. It's gotta be hard evidence for the Death penalty. Both the first and Second convictions. Then maybe wait a year for something important to come up. If nothing changes, drag him down the hall and get it overwith. |

I fully understood the 2nd response, but I'm not sure I understand your first response.
Did you say that the criminal's are just a little closer to the animal world than the rest of us? And did you say that Society makes confusing and contradictory codes of conduct to punish "Itself"? You meant to punish the convicted!? I hope you didn't mean that the Confusing and Contradictory Prosecutions are the real reason these people have two or more felony convictions. I hope I never have to sit through an explanation of "Why" these usless lower forms of life get to be what they are.... |

What I am saying is that we all have the urge occasionally to return to the 'law of the jungle'.Increasing amounts of 'entertainment'are little more than graphic propaganda that promotes antisocial behaviour...the old standard of 'good guys always win' may be corny, but it was constant reinforcement of community standards.
We live in an age where the impressionable are encouraged to behave badly, then punished for it.We need to stop promoting violence as entertainment to stop this abberant behaviour at its source. |

I think I understand your disagrement with Capitol Punishment now.
You said: "We live in an age where the impressionable are encouraged to behave badly, then punished for it.We need to stop promoting violence as entertainment to stop this abberant behaviour at its source." My opinion of your subject differs of course. You may be right about Childrens TV shows that use Violence as entertainment. Even slap-stick depicts what you are against. I went through those TV war's with my son back in the 60's. The Saturday morning Kill Shows. Aside from that, I am discussing the execution of Adults, who made Adult decisions. What if it was made as a result of this Adult's "Society Filter" being distorted by a TV show he watched as a child. So What! He knew the Burgurlary, Theft, Rape, etc etc etc was wrong when he did it. In fact when planning his crime, when he was in 'need' of quick cash, or just bored, he knew he was doing wrong. And he did it anyway! The rest of us did not commit his crime with him. Nor did we encourage him to commit the crime. And we know by his 2nd conviction, that he's not going to stop! Now we have a wounded animal. An Animal of alternate Social responses. A Dog that chases Chickens or Sheep! There is no known method of 'repairing' him. On the Farm we'd just shoot him. In the city, a dog that bite's takes his last trip to the Dog Pound as soon as we are sure it's him. This 2nd offender is no different! Isn't this strange? We are having a tough time making the right decision over punishing this 2nd offender, this repeat criminal, and he has no problem making the decision to violate us again! Ironic! We both are exhibiting weakness' similar in nature. |

As for why we don't execute, a lot of people believe that humans don't have the authority to determine whether someone should live or die, regardless of whether they're a career criminal. They're also worried about the possibility of an innocent being mistakenly convicted and killed. I say 3rd strike, you're out. If we do kill an innocent, that is very sad, but how many have we saved? 70% of released inmates end up back in prison, which is a veritable country club. My mother knew a man who deliberately committed robbery so he could get his teeth fixed for free. (I used to live in Canon City, CO, home of the recent forest fires and also home to 7 federal and state prisons within the county limits, so I know about prisons and prison towns.) Another argument against execution is that it is "way more expensive than paying for an inmate's life in prison". That's what they tell me, though I have yet to see any proof. I doubt that an injection and the requisite paperwork could be more expensive than an inmate's food for life, let alone his housing, psychiatric care, medical, dental, etc.
Here's my suggestion: ship all 3rd-conviction inmates up to Mars and dump them off. At best, they'll form a society and work to stay alive like the first Australians did, and at worst, they'll become much-needed fertilizer for when the rest of us decided to inhabit Mars. No, I'm not kidding. Yes, I know it would be expensive.

Can you see the weakness in that statment? "I just cant bring my self to execute this man" "Something in me is afraid to do it" The guy doing the talking makes all kinds of excuses, religious and philisopical, to keep him from approaching the Paradox of the Death penalty. Remember I said "upon the 2nd felony conviction" and I also said "Not a conviction that was a 'Sell Job' by a good procecutor. The guy I'm talking about is definatly guilty, and isn't going to change. There's no logical reason to avoid execution for the guy I'm talking about. No wrongly convicted guys here! As far as the cost is concerned. I think a year is enough time to plan and execute an appeal. That should cut down the cost. I believe that statment about the cost of execution being higher than the cost of incarceration is just plain BS. I thought of isolation for criminals too There's an old Prison Island in the bay southeast of Sewered Alaska. I thought we could give each man convicted, and bound for that island, a good Coat, Five dollars in quarters, a fifth of booze, and a knife. The population would soon level itself. The Remaining prisoners would have plenty to eat. |

Most of that was way to long read but I'll get to my point!
I'm going to be a defense attorney and if anyone keeps needing to be defended in the court, then I say keep letting them be sent out. The thing is, how do you know for sure that someone isn't going to change. You're not one to judge that. The govebnment is, which I don't exactly agree with them either, but different story. Also, with most of us being street racers, since this is a street car forum site, a felony could be getting caught street racing which is now starting to be big time illegal in California. And to think about those outstanding speeding tickets. They'll have to add to something. I do though think that death row should be cleaned out and execution should be harsher. AN eye for an eye, or :flamer:, or :badass:, or :greenchai, or :eshooter:......you get the picture. ![]() ![]()

You need to edit your posts a little bit, I couldnt understand what you meant in the paragraph about the "Defence Attorney", or at least I hope what I think I read is not what you meant?
The rest of 'Your point' says, "I wont take a chance on executing a guy because he might re-habilatate" (I cant make a decision) Just how many chanches are you going to give the guy? Are you going to re-imburse me for my losses to this guy? And when he finally Kills, or Rapes in the process of comitting a crime? Then how will you re-imburse the Victims? Two solid convictions is enough for me! On street racing, you know it's wrong! I think its a Misdemeaner anyway. You could jump into politics and try to make a law. Street racing Legal? Can you see how silly your stance is now? |

Well if an offender comes out, back into the situation that got him/her into trouble in the 1st place then we cannot expect them not to repeat. What we need to do is give these people life skills or relocation so that they can come out in a different situation and be less likely to repeat their illegal actions.
