35 cars waiting to be legalized by MX some of you need to read this
This is the same post I posted on Skylinesdownunder and fresh alloy.
This is the portion of a letter received from DOT: You ask what the status of your vehicle will be under the notice of tentative decision to partially rescind the import eligibility decision covering 1990-1999 Nissan GTS and GTR vehicles that is being published in the Federal Register today. Our system identifies your vehicle as having been declared as a 1992 R32 model. As indicated in the notice of tentative decision, this model and model year will no longer be eligible for importation if the tentative decision is made final. If the tentative decision is made final, future imports of this model will be barred. However, since your vehicle was lawfully imported under the existing eligibility decision covering 1990-1999 Nissan GTS and GTR vehicles (as denoted by vehicle eligibility number VCP-17), it would not be affected by any future modification of that eligibility decision. Under the terms of the DOT Conformance bond that is furnished for an imported nonconforming vehicle at the time of entry, the vehicle must be brought into conformity with all applicable Federal motor vehicle safety and bumper standards within 120 days from the date of entry or be exported from, or abandoned to, the United States. We have not received a conformity package for your vehicle, even though considerably more than 120 days have elapsed from its date of entry. On November 3, 2005, we notified Motorex that it has defaulted on this condition of the bond with respect to your vehicle and 34 others that it imported. The letter stated that if Motorex failed to abandon those vehicles to the United States by November 21, 2005, or deliver them by that date to Customs for exportation from the United States, NHTSA would commence proceedings to forfeit the DOT Conformance bonds covering those vehicles. Through its attorneys, Motorex requested an extension of this deadline, which we denied on November 18, 2005. If you are one of the 35 owners you will need to post a submission in reference to: DEPARTMENT OF TRANSPORTATION National Highway Traffic Safety Administration [Docket No. NHTSA-2005-22654] Reason: I spoke with DOT and some other experts in this matter and my understanding is if there are enough submissions then some type of action will need to take place by the DOT to allow these in limbo cars a one time waiver or a type of dismissal because the owners of the cars tried legally to import the cars and now the're being screwed because of two clowns and is their trying to do the right thing a reason to be punished, not as far as I'm concerned, I think it should be comended. I'm not an expert but if you are speak up let your voice be heard. If you say nothing then nothing will happen in your favor. DOT has to read all submissions posted by following the link listed below, Wether they take action or not depends on how many of you write a submittal. We don't need to have DOT bombarded with nonsense, these need to be well thought out crafted letters that cover all points about your situation in regards to your imported car and MX. taken from illegallyblondes post dated 27 NOV 2005. here's the bad news from NHTSA, To view the documents goto the main search page: http://www.gpoaccess.gov/fr/search.html 1. Select "Volume 70" in the list box 2. In the search field enter "NHTSA-2005-22654" (make sure you put the quotes around it or you'll get tons of bad results. 3. Hit SUBMIT, and it should be the first one (Notice of Tentative Decision To Partially Rescind Decision That ) and you can view HTML or PDF Reply With Quote PM me if you need help, we can all work together to defeat this thing. The majority of the 35 are Military, ex Military, or retired Military like me. I need to get this fixed so I can move on to other things and so do you |

It would be nice, but I would be extremely surprised if it happened.

I concur. I received my letter from the DOT today. It does not mean, however, that I'm not going to do everything I can to stop it.

Some cars have been released last week. Seems like R33's...only, but cars are being released by the DOT.

R33 are still legal to be imported. However R34 & R32 are not except for off-road use. Talk to DOT and tell them the exact situation and they can get individual waivers.

Re: 35 cars waiting to be legalized by MX some of you need to read this
Only the '96s (according to the DOT)...the 96's still aren't legal by the EPA as they aren't OBDII compliant.
It would be prudent to come to the realization that if you wanted to bring your R32-R34 GTR stateside, you missed your window....and it won't be likely to open up again for another 8 years (for the 89's). Quote:

G & K had a 1995 R33 here that they were going to crash test. With the whole Hiro situation, everything went into limbo for a while. I got busy with the race car. Right now its still in limbo. |
