Depends on the city you live in. Check the law there, but those are usually difficult to fight.

Well i dont know about NY but in MA you can get ticketed for any of the following, Music to loud, exhaust etc. If your car/system is i believe in a decibal range u can get pulled over.

Re: Noise polution in NY??

Actually it's pretty interesting the other day I was driving on a state highway in NY and saw a sign that sounds maximum noise 80bd. Never seen it before but I guess the on state roads the most amount of noise you're allowed to produce is 80bd. Peace-

It's not BS, your car was loud so you got a ticket. That's the law. However, you can fight it. Find out the legal limit, then do one of 2 things.

a) get ahold of a decibel-meter and find out if your car gets that loud, chances are it will if you have exhaust.

b) ask the cop in court exactly how loud your car was. If he didn't use a decible-meter...how the hell will he know. He wont be able to prove you were over the limit, case dismissed.

For b: If he has evidence, then he has evidence. If he doesn't, it's just his estimate of how loud your car was. Ask in court if he has had training in estimating the loudness of sounds. Bet he hasn't. And it's still just an estimate. Most noise statutes have a distance and volume limitation, so watch that when you go in.

Also, you'll want to back up this argument with some sort of evidence of your own, showing how loud your vehicle is. We all know it's pretty loud with a free flowing exhaust, yah? How important is it to you to beat the ticket? If very important, it might be time to put on stock exhaust, have the decibels measured, and/or take a decimeter to court to show that it's not too loud.

Hey, part of the penalty of high performance....

Re: Noise polution in NY??

Like IGOVERT said he needs to prove to the court that your car exceded legal limits For a cop to give a speeding ticket he needs to prove either, he used radar, or he followed you and clocked you w/ his speedometer....In both cases, speedo and radar needs to be calibrated to stand up in court....I live in NY...In Suffolk County you can write to the P.O. who gave the ticket and request a "Supporting Deposition"....This is a written explanation from the cop telling how they came to the conclusion that you are guilty of said offense... Send it, "registered-return receipt" to the precinct the cop works at....For one....it makes them work harder by having to type up another report. Two it gives you an early idea of what they plan on using in court on you. Once they write this report and send it to you before the court date they can not add any new evidence to convict you.... If you dont get it before the court date, show the judge the receipt from the Post Office and tell them you havent gotten a response from the Officer, and would like to adjourn the case untill you recieve the "Supporting Deposition" Basically they have to prove your guilty before you prove your not guilty. The judge may offer you a really low fine to not have this back and clear his docket, and prevent the cop from missing more street time
