Re: car wreck

This happens a lot, when police aren't sure who was at fault in the accident.

Were you involved? If not, you have nothing to worry about. Take pictures of your car and show up in court. Bring pictures and the registration to prove it's yours, and the judge will tell you you can leave.

If you were involved, things can be a bit more complicated. First off, report the accident to your insurance company. They'll want to know where were you in the accident, what happened, were you injured, and other details. (I used to do car insurance claims).

I can help you out more if you can give me a bit more info.....

Re: car wreck

So the car in front of you rear ended someone then you rear ended the car in front of you? Sounds like he was at fault for hitting the guy in front of him, but they'll probably say you are at fault for hitting the guy in front of you unless you can prove his brake lights weren't working.

Just ignorant speculation but I'll bet the guy in front of you is telling the cops that you rear ended him first and caused him to hit the car in front of him - people can be shitty that way.

Re: car wreck

Which car did you hit? Let's label them 1 and 2, the ones that were stopped to turn at the light. #3 is the guy that rearended #2, pushing him into the intersection, then #3 goes on to hit #1 also. You're #4 and came along and hit.....#3?

You're right about what's going to happen, #3 will say you pushed him into the other two. But once the insurance companies finish their investigation, they will find that:

#1 will say he was rearended by #3
#2 will say he was rearended by #3 and felt two impacts(one when #3 hit him, one when #3 was pushed back into him when you hit #3)
#3 will say you rearended him and pushed him into everyone
You will say that #3 hit the others, then you hit him.

So it's 3 to 1 against #3's story, and everyone will know he is lying. The evidence will show that #3 hit the other two first, and he will be on the hook for their damage, as well as his front damage.

Depending on your insurance company and the state laws, either #3 will be responsible for your damages, you will be responsible for your own, or the cost of repairs will be split by you and #3. Check with your insurance company to find out the status. (you have reported the accident already, right?)

This kind of thing happens all the time, and although #3 is the fu*k-up, you may be partly liable. The way the laws are written in some states, if you rearend someone, no matter what, you have some of the blame. It sucks I know, but it's the law. The law isn't fair in many cases....

Anyway, make sure to have the details firmly in mind, as all 4 insurance companies will probably want a recorded statement (especially if there were injuries) and you should be consistent in your story each time.

Re: car wreck

if there is any damage to your car I could see why they would put it on you. But people will lie their asses off in car wrecks so it wont be their fault. It would would be best to get a lawyer to have him do all the talking for you.

Re: car wreck

anytime you rear end someone, no matter what, you are at fault. Usually the courts will say something like, if you werent following so closely you would have stopped in time. The law sucks, but thats the way it is. You were going to fast to give youself ample time to stop. Brake lights or no you can still see if a car is slowing down or crashes.
