Failed to yeild.

Was going home from work and at a 4 way stop, I kinda didn't come to a complete stop, I slowed down, made sure no one was comming and accelerated.. Got pulled over..ticketed. So far I have plead not guilty, the fine is 90 bucks. I have a court date in January, think I can get this erased? Reduced? I wonder if my rates will go up. I already pay 200 dollars a month for insurance.

BTW I live in Staten Island, NY.

Re: Failed to yeild.

NO I think the only way you will get out of the ticket is if the cop doesnt show up.. a stop sign is just that.. STOP.. NOT slowed down, kinda stopped.. thats waht the prosc. will say.. save your money and pay the fine

Re: Re: Failed to yeild.

Well it is my first time being pulled over. Do ya think I might get it reduced or something, It's just that I don't want it to hike up my insurance.

Re: Failed to yeild.

You can ask. just depends on if its a small town or big city. and if the prosc. is a nice guy. if its a big city most likely the officer wont show, because he's working or on his day off. if he's a no show, plead NG, it will be dismissed, because he's not there to testify, and they have to throw it out. if its a small town, more than likely the officer wants the OT so hell show in court. either way all you have to do is ask. BUT in all reallity you get something, because its money in their hans now.. GOOD LUCK

Re: Failed to yeild.

Uh, how fast did you go through the stop sign?

And where was the cop? Obviously you didn't spot ALL the traffic....

Like 10 mph, I have no clue where the cop was, but there were a lot of places to hide. I didn't blow it.. I sorta rolled through it, but none of these things are on the ticket.

Re: Failed to yeild.

10 miles per hour?

If you say no one was coming, the officer will probably say he was right at the intersection and you didn't see him.

Then you can either say you saw the cop, and the judge will ask why you didn't stop, or say you didn't see the cop, in which case the judge will say that there could have been other traffic and that's why the stop sign is there.

You're screwed; just pay it. Stop next time.

Re: Failed to yeild.

Screw that, I say plead not guilty and go to court. There is always a chance that the cop/assistant DA, whoever will cut you a bargain before you even go into court. I've had friends get running red lights dropped entirely or reduced to disobeying a traffic control device. My philosophy is always go to court and contest it if there are points involved. What is the worst that will happen...they tack on anotehr $20 or $30 for wasting the courts time if you lose? Go and try to get it reduced, especially since it's your first offense.

Re: Failed to yeild.

I think they tack on a bit extra for wasting the court's time. It's anotehr little way they try to intimidate you away from fighting tickets.

there is however a slight chance that he doesnt get paid 400 a day, so its totally worth fighting because his insurance would go up and cost a helluva lot more especially if hes under 25.
