my friend's lady's echo turned over in 45* turn...
she got out of the free way going 35-40 mph and the car flipped at the turn...who's fault is it? driver or echo's designer?

I'd say driver. Sure, the echo tends to roll around in corners, but it must've taken some bad cornering skills to make it tip at 35-40mph, either that or a very sharp corner. The tires most likely would've given out before flipping if it was just taken too fast. I race my echo frequently and I take hard corners very quickly and i've never come close to tipping over.
