Angry Loudest Tiburon

HAHA well today I get pulled over for not speeding, but b/c my car is too loud. According to FL Law anything that makes your car louder than factory is illegal. This is total BS* The only reason he pulled me over was b/c my car is an import. Lets see them pull over a Mustang for having a aftermarket exhaust.. If anyone has any legal advice for me, b/c i honestly am thinking about going to court for this one, please share the knowledge. Oh its a $71.50 ticket. Plus I was pulled over in an area where there are no houses, not like i was roaring through a neighborhood.

I can get you more information if you need it, but what part of FL? Some counties are stricter than others. But, basically, did he show you a reading from a db Meter? If not, then chances are he did not have one. That is easy to fight in court. They will throw it out with out the legal proof of your db level, and if he doesnt even show up, which he probably won't, it is automatically dismissed. Now if he had a meter, it is still arguable with good chance of winning, because you can question the calibration of the meter, proper training on the use of the meter, and so forth. Most the time things like a db meter are kinda left in the backseat of force training.

You could get a test done just for reference, but I am willing to bet he used the noise as a probable cause reason to pull you over, so he could check your info and stuff. (Do you look suspicious? Lol. J/K) Nah, but they do that to search for outstanding warrants and such which leads to faster promotes for them. If they find nothing, they make the state some money which still looks good. All in all a b/s ticket.

It was a bike cop and he pulled me over and said your car is louder than the stock muffler. I was like I know b/c I have head work done and a custom exhaust. He told me that anything done to a car that makes it louder than what was stock is illegal. He didnt show me any readings at all. I guess its b.c I have a nice looking car and I fit in the range of 18-25 male range.

HAHAHA that guy just wanted a look at the car. lol you can easily fight that one especially if he said it was illegal to have a car any louder then stock...how would he know what your car or any other sounds like stock ?? i say fight it if you dont win then the whole place is bs!!!!

how did he know your car was mor ethan stock?.. was it your exhaust? stereo? what?...

if it was your exhaust did he have an instrument to measure the sound decibles.. and same with your stereo?

that is the dumbest law I have heard of! Before my Tib I had a '00 Cavalier with my exhaust cut off and a straight pipe put on with a monza tip put on. It was of course louder than stock...and didn't have any troubles. That cop was just looking for something to get you for. That cop is a --->>

Dude just take that shit to court and plea "Not Guilty". I just moved from Orlando a few months ago, and I very highly doubt a cycle cop has a db meter. No where on the bike to stash the damn thing. He was just trying to cure a case of boredome. That and they have been trying to impede the scene out there, because im sure you know how it gets on Sat nights down OBT. lol. Cops assume if your car is fast, you must be trouble, so he checked on you cause you may look fast. I really wouldnt sweat this one.

Yeah all the bike cop said was your car is loud* I wasnt even in a residental area where I got pulled over. I knew this cop was picking on me b/c he made a U turn, ticketed me for the exhaust and ticketed me for haveing a license plate cover! So I'm going to go down to the police station and ask them if i put one of those silencers in my muffler if they would consider that a fix, if not "NOT GUILTY" is my plead!

<haha you ever seen that commerical with the bike cop pulling over the parked celica and it cuts to "It looks fast"> thats my car

Yo guys I'm new to posting. I live in Winter Park and I have a friend who is a Seminole co. deputy. He informed me that the law states that your car can not exceede 96 db at 50 ft. But for an officer to say you exceeded that he needs a db meter that has been calabrated and certified. There is not a single officer in Florida who has one. So my advice to you is plead not guilty and make the officer proove that your car was too loud.
Also here is the Fl. statute
316.272 Exhaust systems, prevention of noise.--

(1) Every motor vehicle shall at all times be equipped with an exhaust system in good working order and in constant operation, including muffler, manifold pipe, and tailpiping to prevent excessive or unusual noise. In no event shall an exhaust system allow noise at a level which exceeds a maximum decibel level to be established by regulation of the Department of Environmental Protection as provided in s. 403.061(13) in cooperation with the Department of Highway Safety and Motor Vehicles. No person shall use a muffler cutout, bypass or similar device upon a vehicle on a highway.

(2) The engine and power mechanism of every motor vehicle shall be so equipped and adjusted as to prevent the escape of excessive fumes or smoke.

(3) A violation of this section is a noncriminal traffic infraction, punishable as a nonmoving violation as provided in chapter 318.
