I'll tell you how.
Change all their employment contract condictions from "part time" to "casual" to avoid having to pay them the rates stated in the awards act of 1977. That's right. I started off part time, but I was forced to sign a contract 2 months ago to say i'm now casual. All the drivers and crew did, or we will be terminated. Now I know why. My asshole boss didn't want to have to pay us holiday rates, and public holiday rates (double time and half), nor did he want to have to pay ANYONE weekend award rates, overtime, or the late shift rates. He's the greedyist pig fuck i've ever met. That being said, if you are looking for a job, go part time, NOT casual. I had to check the Industrial Relations website today, and they said that causal employees are "award free", meaning we are not entitled to any extra pay, no matter what the circumstances. I can work christmas day, and still get paid the same amount to what I would be getting if I was working a random monday afternoon, that's fucked. I'm going job hunting, gunna look for a good part time job that pays well, and I'm not using my car (I hate one of my managers too, so it'll be sweet), and when I find a job, I'll tell my boss to stick his pizza's up his ass. |

Re: How to avoid paying your employees award rates?
sounds fair to me, a pizza in the ass may not be the best way to go.
There is so many ways that people can be worked like this. and i am not going to explain them all. As an employer, i think it is just a shitty thing to do. but it happens to everyone at some point. i know i had shitty jobs that cut corners where they can before i got into what i am now. its life, and people are greedy.

"Forced" you to sign or be fired....hmmmm sounds like he's being a bit unlawful there, doesn't it?

Re: How to avoid paying your employees award rates?
Well, what my employer does is she takes all my overtime hours and pays them as a bonus at my regular rate to avoid having to pay me overtime.

Claw, if you're in the US and are working more than 40 hours a week, your employer is in violation of federal labor laws.

Re: How to avoid paying your employees award rates?
agreed.
My boss said a new law came in and we all have to sign new contracts, this is true, but what he didn't tell us is that it's also a change of employment contract that basically states that we've been moved all to casual. |

That is complete bull dude. I don't blame you for wanting to quit. Perhaps you should do some research because this seems as if he had broken a law or two. There is nothing sweeter then revenge.

Re: How to avoid paying your employees award rates?
yeah, well, i should of read the contract i was signing, i didn't cause it was like 5 pages long, and i was like "ha, fuck that", he explained what it was, he just left 1 minor detail out, that i was going to casual.
The only problem i have with that, is I don't get paid public holiday rates. I never got overtime, which didn't bother me, i only do about 3.5 hours a day. |

Re: How to avoid paying your employees award rates?
Ya think that he left out the fact that you'd be casual on purpose? Of course he did. Bastard.

Employers take advantage of their workers. Workers take advantage of their employers. Centuries old conundrum.

Dang, shouldn't have used the word "bastard" in my post. Now Yogs is in on it.
![]() It's true though Yogs; every company I've worked for has some policy that was set up because someone abused the system.
