street racing ticket while not street racing?!?!

my brother got a ticket for street racing when he just accelerated fast up to the speed limit. he asks the cop how he could get a street racing ticket without actually racing sombody. the cop said they can now call spinning your tires and going into high rpm's street racing, even if nobody else is around. WTF. how the hell could that be. that just defies the name of the ticket all to hell.

Fight it, if he wasn't squeeling tires, then you might have a good chance of winning. Some stupid small town cop with his stuck up his butt can't define the law. Fight it.

Re: street racing ticket while not street racing?!?!

Would it be street racing ticket if you did not squeal your tires but still got into higher rpms. Even if you stop at the speed limit.

Re: street racing ticket while not street racing?!?!

I wouldn't think so. I would think that it's your right to blow your engine. If you want to run it past redline it's your right. As long as you're driving safely, obeying the law (not speeding, squeeling), then I would hope that you can run your engine in high rpms. Let us know what's going to happen

Re: street racing ticket while not street racing?!?!

I think that it should still be fine. I guess there could be some extreme circumstances where there were children on the sidewalk and he accelerated to 60 in 6 seconds, that might be unsafe, because those children could easily step off in front of him, but especially if it's an open road with not many people around, he has a very good chance of winning.

I say you should be able to accellerate how ever fast you want! Damn, its YOUR car. What do they expect...manufacturers to put an acceleration damper or something on all cars now so they dont get to the speed limit too fast? WTF! I can see if he infact DID squeal his tires...cuz Ive gotten the ass end of that deal before racing my buddies. But even then, some people accidentally squeal their tires if they have standards...it just happens. If he indeed was being wreckless, THAT is what he should have gotten the ticket for.

Re: street racing ticket while not street racing?!?!

in cali you could get arrested for that, but not that often. It seem pretty stupid, but if you redline you car, or simply call it engine braking and they pull you over, then you could fight that.

Re: street racing ticket while not street racing?!?!

I squeal my tiers all the time. Mostly when its wet since I have a heavy car and FWD if its really wet the wheels will just spin and the car sits there.

Re: street racing ticket while not street racing?!?!

There's no law I know of that says there's a limit to the amount of acceleration. Speed, yes. If you go 0-60 in 1.1 seconds, and the speed limit is 60, and you didn't squeal your tires, there's nothing you did wrong. Acceleration in and of itself is not a crime.

Re: street racing ticket while not street racing?!?!

There are laws against execive acceleration actually but it varies state to state. And get a VR4, that way it's alot harder to squal your tires and easy to prove that you could not have lol.
