They're completely legal, the 49cc engine makes it legal to ride anywhere a bike can, and you don't need a license to ride/drive it.

It's different state to state - in many states they are not road legal (depending on how they are equipped - most states require headlights, blinkers, brake lights and mirrors).
In some states, you are only exempt from needing a license if the bike has an engine of under 50cc and pedals - that is it must be a moped. Many states also have an age limit for vehicles powered by an engine of size under 50cc, alot are set at the age of 14, and few are all the way up at the age of 16. Check your own state's laws, as they do vary quite a bit state to state.

those bikes are sick, my friends little brother bought one and i pulled a sick N-DO on it and some wheelies. I fliped it in a field though, hurt like shit but they go so slow no real damage to the bike or me.

There not legal here in canada if you are caught with one it is a big fine so mu advice to you before you get one is make sure there legal in your state

are they 2 stroke or 4 stroke engines? You can be a rebel and hook up a universal n2o kit to it and pull a quarter in the low 30's
