A letter to a liar!

Dear Mr. Williams:

Due to the fact that I was given false information on the car, I would like to request some compensation for the articles listed below:

1. Over the phone the first day I spoke with you, you told me that there was “an Integra LS” engine, also known as the B18a1. The engine that is in the car is a ZC DOHC non-vtec. The ZC was never in any Integra LS. Attached to this letter is proof that there was never an Integra LS with the ZC DOHC engine. The ZC DOHC was never released in America either; only through import can this engine be available.

2. You also told me that the body model was an HF model, which is lighter in weight, resulting in better gas mileage. The body for this car is a DX.

3. The front end of this car is supposed to be a Skyline front end. I have been told by the Manager of the impound company, and a few knowledgeable friends that this front end is a fake Skyline front end, and that a real Skyline front end would not fit on this car. Through research I have found that this is a very poorly attached replica R33 Skyline front end. I have had to re-attach this item twice since purchasing the car.

4. I was also un-aware of the ECU throwing a code 9. (This means the No. 1 cylinder position) As a result I will need to purchase a new distributor to fix this problem. Acura of Mission Viejo has informed me that this piece alone is at least $300.00. You told me that there were no mechanical problems other than the clutch.

5. I was also told that this car comes with Corvette floor mats, which were removed from the vehicle before I bought it.
When I first spoke to you on the phone you told me that you were looking for $5,600.00 for the car. A couple days later I went out to see the car and was told you now wanted $5,800.00 for the car. Then you increased the price again to $6,000.00 including the amp, which on AutoTrader.com you listed came with the car. In our contract we agreed my truck (as is), which was valued at over $4,000.00 according to Kelly Blue Book, and $3.400.00 in monthly installments, for the car, but decided the price would not include the amp, which was removed from the car.

Through giving me incorrect and false information about the car, it is my opinion that our contract is now null and void until we have come to an agreement which we feel is best suited for both of us in this situation.
In the following I have stated what I feel is a fair compensation for the issues stated above:

All I am asking for in compensation is the Alphasonik amp that was taken out of the car. If you can return that piece to the car, I will be happy to ignore the previously listed issues and continue to make payments, promptly and on time with no further issues.

If you feel that this statement is invalid or false, I feel I would be forced to file this through small claims court in order to resolve the situation in a timely, and fair order.

I'm sorry i didn't understand from your other thread; but you actually thought that it was a REAL skyline bumper on the car?
But if I were you i'd at least have him give you the floormats and pay to get the alternator fixed along with giving you the amp. Or at the very least knock off $450 to replace the floormats and and the alternator (and install). But that's just me.

So your making payments to him? Also did you get the pink(title) to the car?

I hope you got the title....if you didn't after you pay him he can just claim the car was stolen.

get some money taken off the payments too... claim that the LS engine is worth much more than a ZC engine.. tell them the mount kit itself is worth as much as the ZC engine... say that you had a buyer setup for the mounts and swap for 1500 bucks...

that should get you some money taken off the total cost so that you wont be toooo ripped off

not a rel skyline front end...that;s just the name of the kit...make sure u keep MO stubs for proof of payment

i would have also told him that ur taking money off the payments to replace the broken things (distributor and front bumper) and its his fault for not telling you, also, even though the distributor may be 300 at the dealership, just get one off e-bay for like 80 bux, but tell him u paid 300 plus tax let us know how it all works out

So I dropped the letter off at his house with his dad, he was not home. I am in the shower getting ready for work and he calls my cell phone and leaves me a message saying something along the lines of...

"I got your letter here, and i will gladly take you to court. I am taking the car back, the pink is in my name, your trucks pink is in my name, you messed up with this little letter here."

he goes on to tell me how he told me it was an integra engine. Never saying anything about how he told me previously that it was an LS engine.

So he thinks he is gonna reposess the car because i called him on his lies. I don't think he can legally do that... but we shall see.. I gotta find a nice attorny to tell me what exactly I can do for this...

Any suggestions on what to do? I guess I will have to take him to court.

I dunno why he got so pissed off about it...

save the message and lie about knowing it is a JDM intega engine...besides...itz not a usdm engine...and he would get the car from me...itd be sitting in storage until the situation is handled

I would be storing the car in a friends garage until this goes to court or is resolved.

and if he comes over with the police and ask where the car is just state it not on your property. and if he asks where the car is, just say this is a personal matter between me and mr.XXX to be resolved in court.

also please tell me you have written a agreement on paper... some sort of sales contract.

because you know the saying, a verbal contract is not worth the paper it's written on

I agree with Kunundrum, unless you have something on paper that he signed, and perferably dated, it's your word against his, and both of you are going to loose something (court costs, whatever) because it will get messy.

Store the car somewhere that is blocked off, or in a fenced in locked lot, or blocked by other cars so there's no way it can be moved. And perferably not at your property.

If you spend money on the car, save all reciepts.

Why do people lie when they try to sell a car? They're gonna get what's coming to them sooner or later.
