Could driving 10-15 min up hill stuck in first gear cause clutches and steels to badly burn up along with melting second gear band be dertermined as abuse (racing) causeing tranny to go out?

Hmmm. I'd think your engine would have given out first. Out of curiousity...are you looking for an excuse for your transmission failure? Did you actually damage it from racing? Don't worry I won't tell
. I'm assuming this is an automatic trans., yes? I would think if you were to "lug" it in second gear, you'd do more damage to the trans., a lot quicker. But to finally answer your question, yeah, it could possibly be looked at as abuse if you've got melted and burnt parts. Are you trying to get a warranty repair? Some dealers will look for any reason to not give you a warranty repair, especially if the damage in question suggests abuse.

LOL.. no we were not racing the car. Actually we (my fiancee and I) were on our way home from the movies..LOL and it wouldnt shift. Yup its an automatic. Actually the Tranny was giving us problems befor, it was slipping and stuff so we knew it was about to go just he didnt take it in. grrrr....LOL The place thats looking at it said it went out because of abuse, duh with the way we drive it home yeah..LOL Yes its under warranty and they are not going to give it to us because of abuse. We just moved here to washington from Cali and the guy that looked at it in cali fixed the Tranny the first time and the tranny died 8000 miles out of warranty, he siad we were racing but come to find out it was mechanic error we still had to pay 1600 for a new tranny.LOL.... so now he is still telling the tranny shop here in Wa that we raced it befor and thats why it went out then and thats why its going out now.. ugh. Ok, I have a few questions for you
. Did you buy this car new or used? How many miles are on it now? Were the previous repairmen certified to do Plymouth/Dodge or Neons in general? Beacuse if you're being totally honest, and you've kept your receipts from the previous repairs...you may qualify for the so called "lemon law". Do you have documentation that said the previous failure was because of mechanic error? I would work my way up the "chain of command" if I were you. From the dealer you bought it from all the way up to Chrysler. Somewhere along that path, someone will help you...either by changing the trans out completely, replacing the car, or even writing you a check for the car when you turn it in. There are people out there that have gotten that far, so it's not impossible. I'm sure it'll take some "work" on your part, and you'll have to decide whether it's worth it. But seeing that you've already invested some money in repairs...even though it's still under warranty...it may be worth a shot. Good Luck. Hope to hear good news soon .

hmmmm... I think the car was used, i believe it was a previous daily rental car, but i am really not sure, He had the car befor we meet. The car had almost 200,000 miles on it, but since then the engine has been rebuilt and its obviously not the original tranny. I honestly cant say they were certifited for the neon its self, but certifited for Transmissions in general. I was actually talking to Kevin ( my fiancee) about the documentation about the Mechanical Error, and we dont have it, they never documented it i dont think. It was just word of mouth, which really gets us no where. Thats really just between The mechanic, god and us..LOL considering I dont think there is any kind of documentation of it. :-(
Its kind of hard to get to the dealer because we moved to Washington about 6 months ago and all the places are In Cali, But we have reported this place to the BBB twice already and are going to do more, and My aunt is good with understanding the Law and who to report who to and even reporting them to Higher more important people. LOL. Well all i have to say is when i am done with This Tranny place in cali I will have their Licence and they will be shut down. And I am going to get all their money, I hope. I am just so mad. I dont know how people can be so mean and dishonest. If it was them and they knew for fact they didnt abuse "race" the car they would be upset. ya know? anyway I am ready to fight this so if you can get any INFO for me it would be greatly appreciated.. Wow...oh wait, let me say that again...WOW!! 200,000+ miles, on a 2000 Neon? WOW!! What did these rental people do, drive the car to the moon a couple of times? And here I am thinking my 105,000+ miles on my 2000 Neon is a lot
. But for me, I've been kinda rough on the car the last 7000 miles (Pizza Delivery). And the transmission does "whirr" a little. But getting back to your car , honestly I think you may have a somewhat harder time convincing the "higher-ups" to take your side, mostly because of the mileage. But don't let that stop you. Did you find out exactly what's still covered under warranty? The BBB is a good start, because that's a "record" of a business making boo-boos. Try calling the dealer Kevin bought it from, if they can't help you, try calling a local dealer in Washington. When you do make these "official" calls, log down the date and time, the name of the person you spoke to, and why they can't or won't help you (If they can't or won't). It makes a difference if they "can't", or "won't"...it shows if they really want to, but can't, or just flat-out won't help you. Be cordial and considerate. It might just help to convince them to help you. Also ask them to refer you to who can help you. I'm not sure how Chrysler's chain of command works, but I'm sure it goes something like Branch, Regional (East, West and such), and Main (the top). An attorney would be a last resort because they tend to get expensive. But your Aunt would probably know better than I do, so she would make a good adviser. But your first step, I assume, would be to call the Cali. dealer, and then the Washington dealer if Cali. can't help. Don't forget, ask them to refer you to who can help you if they can't. And log everything down. Hope to hear good news soon .
