Transmission Problem

I want to start off and say that I have really enjoyed my 99 1.8t Passat and I am not looking for a place to vent but, rather a forum that might add some insight to my problem.

My Passat will start shifting erraticaly. (quick while accelerating and slow when deccelerating)

When I bring it in the shop the only thing they can find wrong is that it is low on transmission fluid (3.5 quarts this time). This has happened twice and both times I was told that there is no leak.

I am not a mechanic or physicist but, it seems odd that much fluid can disappear without a leak. Any ideas? It is still under warranty and I feel I am just getting blown off by the dealership.

Any insight would be appreciated.

Thanks!
