I guess I don't understand why everyone is saying this is insurance fraud? Having the fireworks (I assume just lying around, not being set off while driving) in the car wasn't what caused the accident, and shouldn't affect the insurance company. Withholding information is not fraud unless the insurance company directly asks you a question like "Did you have any illegal items in the car?" Otherwise, you are not required to dispense any information. It is the insurance company's job to inquire of all the info they need to file the claim. 5th amendment is there to keep you from implicating yourself in illegal actions that you did not commit or complicating offenses with unrelated information.
Fraud would be getting in the accident because you were shooting off fireworks, and then lying about why you got into the accident. And as far as driving premiums up... he probably pays a much higher premium than everyone else on this board because he's so young and is driving a mercedes. Besides, this is what you pay insurance companies for, to cover you in case of an accident. I'm not saying none of this is his fault, or that NissanRacing should be completly off the hook, but how about a little moderation before jumping on his case. His dumbass brother totalled his only car. That sucks. No need to kick him in the balls while he's down. Besides, this is the stress RELEASE forum.

i can't belive you guys are actually advocating for the insurance co... they are the original crooks that dip into our pockets and jack insurance rates even though i haven't been on an accident or gotten pulled over for any type of moving violation in the past 6 years. however, there are premium increases every 6 months.
i think the owner of the wrecked car should collect from both ends. from the insurance (since he does pay his policy) he is entitled to the claim. and he should also collect from his brother in order to be able to buy a new car. the fireworks are irrelevant to the accident, the speeding and irresponsible acts behind the wheel can not be held against him since he was not driving. on the contrary, he thought he was doing the right thing by letting his brother drive the car since his curfew was in effect. this guy is looking for moral support from fellow car enthusiasts such as ourselves in this forum, but instead we decide to put salt on his wounds. someone told me a long time ago that strangers seek relief from their own miseries and problems in other's misfortunes.

But Nissan never said he didn't tell the insurance company he was speeding. He just said he didn't tell them about the fireworks. IF the insurance asked if he was speeding, and he replied NO, then that might be grounds for fraud. But he did not say this, unless I completely missed something after reading through the thread twice again. And remember, speeding does not negate your insurance coverage. I was just recently in an accident that was deemed my fault, but the insurance company still payed my bills because thats what an insurance if FOR. Doesn't matter who was at fault. Teens pay higher premiums because the insurance company knows they are probably going to speed and get into an accident.

We were not using the fireworks for whoever said that. Buymeabmw was correct when he said that they were just laying around. And second, if you read the very first post of mine, I never said that he was speeding. The speed limit was 45. What I said was that his speed was too much given the current conditions, it being night and wet. I only said that he was going to fast because he was going to fast in a turn. But according to the speed limit and the law he was not speeding. And so I am not committing fraud and I am not lying to insurance companies.

You got money for the value of your car right.... however much that was. Have your brother give you some if not all of the money from his savings account, and get another car. With that and the money you got from your car, you could get a nice 240 since it seems you're into Nissans. Pay no attention to the negative posts in this thread, i'm sure you've had enough shit from your parents and elders... People get into accidents, it happens. I lost a friend to one 2 years ago, just never let your brother drive your car ever again...That's it, case closed, lesson learned. He is responsible for at least helping you get back on your feet with another car, he needs to take responsibility.
