A loophole in the law means nothing can be done to stop a Wellington woman having sex with a 13-year-old boy.

Ohariu Belmont MP Peter Dunne said the case, brought to his attention by a constituent, showed there was a need to change the law. He has written to Justice Minister Phil Goff asking that he give the matter "urgent attention".

The constituent had said the woman, her employee, was quite open about her relationship with the 13-year-old despite the fact that she was in her 20s.

"The female concerned is quite confident that there's nothing that can be done. She seems to be quite in your face about it," Mr Dunne said. "It's a matter that, were the genders reversed, would clearly be criminal behaviour."

Mr Dunne said the matter was raised with police and other authorities but they said such incidents were not covered by the Crimes Act or any other legislation.

Detective Sergeant Brett Greer of the Wellington child abuse team said: "We investigated it to determine whether there was any criminal liability on the part of the woman, but on the information given to us under the current legislation we were unable to identify any criminal wrongdoing."

Police had spoken to one of the boy's parents. "It would be fair to say she was disappointed with the outcome of the investigation and the inability to charge the woman," Mr Greer said.

According to the Crimes Act it is illegal for a man to have sexual intercourse with children of either sex aged under 16. It is also illegal for a woman aged 21 or over to take part in any indecent act with girls aged under 16.

Boys gain protection from older women only when there is a special relationship, such as mother and son, sister and brother, teacher and pupil or doctor and patient.

Christchurch crown prosecutors are preparing a case against a 47-year-old woman charged with two representative counts of sexually violating a boy from the age of 11 during the 1990s.

Crown prosecutor Jane Farish said only one part of the Crimes Act covered sex between women and boys, and the issue was consent. In order for the charge to be proved prosecutors had to show that the boy did not consent and that the woman knew or believed that was the case.

I know its a double standard to hold men and women accountable for having sex with girls uner 16 but not boys. I know because it was a woman who did it, there won't be much uproard, but if it had been a man..... Whew! The shit would hit the fan! I think that an adult who coerces or capitulates to sex with someone that young should be tried and jailed. There is no call for it.

The way that this issue is tackled leaves much to be desired.Every country and every culture has a different angle on it,and the articlt highlights the fact that males and females are treated differently.Heterosexuals and homosexuals are also treated with disparity,I can't figure out why a person needs to be older to be considered legaly mature enough to choose their own sexuality.In certain states,unbelievable though it sounds,it is still a criminal offence to indulge in homosexual behavior.


We'll never be able to agree on a world-wide age of consent,but if the powers that be[sorry Yogs,looks like a job for the UN] could steer countries into legislating some gender equality and some sexuality equality into their statute books,it would be a start.

For me, the final straw was the "World Conference Against Racism" which turned into Anti-Semitism Fest 2000...

Given the choice between dying fighting for freedom and dying from a nuke blast you could have prevented, I'd definitely take the first.

When I start reading this thread it was about the morality and political implications of a 13 year old boy having sex with a 20+ year old women.

It had nothing what so ever to do with the war in Iraq or the UNs inablity to make decisions.

Lets try and keep it on topic.





Yogs you made a point about how little fuss would be made over it, well admittitly I havnt watched much of the news here in NZ recently but I have learned more about this story reading this thread than I have gathered from the NZ media and from talking to ppl on the street.
I knew something had happened, but it hasnt made headline news and stayed there, as you pointed out a reverse case where an older man had been having even consentual sex with a 13 year old girl would have been played up by the media and enough ppl would have been talking about it on the street that I would have heard something more.

Well thanks for that,Moppie, but where is the thread going to go?Unless someone wants to argue the point for retaining the status quo,it's a pretty clear-cut topic.The UN is the logical direction in which to take this thread,because the U.N. is the only organisation charged with monitoring and developing international law.We don't follow rigid 'stay on topic' rules in this forum,and never have.We prefer to let the argument take it's own course,and inevitably it comes back to what we find most important at the time.Please,feel free to contribute to this forum,but stop trying to turn it into something that it isn't.
