Question klickity klang klang

At low speeds/RPMs theres a metal-on-metal rattling from underneath the car in the trans area.

The sound only occurs at low speeds when shifting out of 1st into 2nd. For example if I'm in the parking garage at work and I shift into 2nd and let the clutch out you hear it but only for about 2 seconds....

I took the car to the BMW Center and they first replaced a heat shield and the silensor on the exhaust. THAT DIDNT FIX IT. So i took it back angrily and they said it must have been a trial and error fix.....

Finally they came at me with some crap that its a muffler flap, they called the BMW tech line and theyre aware of it but theres no fix... and that it wont cause any damage... (I've heard of muffler bearings and blinker fluid but c'mon!!) What the hell is a muffler flap?

Has anyone run into this? Is my dealer just lazy? I'd think ANYTHING can be replaced, cant it? C'mon its a $40K car!!!!
