Dealer Refund

I recently (approx 3 weeks ago) purchased a BMW 323i from a Used Car Lot. THAT was my first mistake. Initially, the airbag light was on, the power steering and transmission lines were leaking, not to mention the sunroof didnt even have a track to slide back and fourth on. Anyway, this was all minor was I figured it would be fixed, no problem. The car was sent back and was kept for almost a week. Got it back with all the lights on the dashboard on (ex. Check Engine, EML, AIRBAG, etc.). Now that I have the "fixed" car back I have yet to check if the leak was fixed. Only thing now is that in addition to the dashboard lights being on, the engine is making a humming sound. Not noticeable but really - why? What did these "repair" guys do. The sound wasn't happening before.

My question is, since the car is only 3 weeks old, what are my chances of getting a refund of my downpayment? I'd like to do to another dealer and purchase a car there (a more reputable one). If not, what other options do I have?

Re: Dealer Refund

I would say a refund is very unlikely. Read the fine print on the back of the sales contract.
The best you can hope for is a refund if they cannot fix the problems.
As for the problems, I would not call them 'minor'
Check engine and airbag warning lights as well as leaks can be indicative of serious and expensive problems. Were these problems evident before you bought it? If yes, did you have it written into the contract that they would be fixed?
If not, all you can to is complain a lot, and perhaps have a lawyer look over the contract and send them a threatening letter, and possibly file a small claims suit, if nothing else works.
