thanks. So basically depending on the law, you can make a new transmission like a 7 speed sequential and mount it horizontally like McLaren instead of the usual vertical because you wouldn't be copying the entire thing, just the idea of the layout. and after 17 years you can make the exact same thing?

I think you are right, but you really should consult a patent attorney. In general, though, yes, just the orientation of the transmission with respect to the crankshaft is not enough to constitute a unique innovation or invention. The coupling mechanism might be, though, so make sure that is your own design (and make sure it works, or you will have pissed off customers).
After 17 years, you can do anything, as long as there are no interim patent filings that you would be in violation of. It's 17 years from the filing of ANY patent applications that you could be in violation of, not just the first one. |
