Got ripped off on parts for my 240... anyone here a lawyer?! lol

Some of you might remember wen i was doing a 5 lug conversion, how i got the rears done but not the fronts. Well the shop that sold me the 4 hubs for my car dont know much because only the rear hubs worked and the front ones they sold me off a sentra or something...

So i get home and take my car apart and try to do this swap and what do you know!!! the front hubs are different from mine. and would not work at all... SO... i go back there and tell them whats up, and they said ok well we can give you store credit for the $150 for the pair of front hubs, and i said i want my money back, they said no... so i said ok ill wait and give you guys a chance to find me the hubs that i need...

So, for about a month i was bugging them and they had nothing for me, so i ended up buying the hubs from this dealer in AZ for like $200+

Now that i finished my front hub conversion i went back there and told them that i need my money back because i dont need the hubs anymore, nor do i need anything else from you guys... and they said well maybe you will need something later, like you will brake a light or something, and im all Nope!! i need my money back, its $150 and im broke... The guy kept giving me crap about how there is no refunds no exceptions blah blah... im all dude , listen, you sold me a part that u do not have and then you telling me there is no refudns, how does that work?! Then hes all welll sorry man, boss doesnt allow refunds.. and im all and who are you? and hes all , im the manager, then im all ok and whos the boss? and hes all steve, and im all ok , ill have a talk with steve.

So then i call that same shop and i ask for steve (boss).... Jason is on the phone (assistant manager) and john was the manager (big fat guy) ... so i go... can i talk to steve?, jason goes.. steve? im all yes steve.. hes all steve used to own this place? im all what?!!! he asked me how i can help him... and i told him whats up, and i already talked to him before.... so he knows everything.. so i go... so wait the manager (big fat guy) told me to talk to steve, so pretty much he told me to go talk to someone who doesnt give a crap?! ... hes all ha ha i dont know man, im all ok, ill come by later and have a talk with big fat guy...

After that phone call i took my butt to Small Clains court... and got some paper work, and talked to Beraue of Automotives. For the last time ill go in and explain to him that its his fault and no where near mine so he owes me $150... Only if i take him to court i will be asking for $300 because its been like 5-6 weeks already since my purchase, and all the time, and gas and crap i had to put up with them...

ok wheeww had to vent out there lol, because im being kinda nice to these guys still... and nobody to went out on... i love you guys *sniff* haha

those guys are dicks.. i know that the parts guys at the dealership i worked at would atleast have bought one from somewhere else to reimurse you if you didn't get the right one.. but i'm in canada so i can't help you with the lawyer thing.. i hope for the best man. that really blows..
but look on the bright side.. or, just look at your car!! you got the hubs done!!

well ur car is ok , the money is not that much ($300 is a llot of money to me! ) but it could been worse.

You get a big ass bottle of vodka, half full, get a rag and soak it with vodka, tie a knot in it and stick one end in so the knot is caught in the neck of the bottle and one end is in the vodka, then light up the rag at the other end and throw. Repeat 3-4 times and then run like hell.

and i didnt say nothing before because i was hoping they would come through or something... i wrote a letter to them saying that if they dont pay me by a date i specify then i will pursue any and all legal remedies available to me...

im not gonna let this stand! its not really for the money, its mostly for like " YOU GOT OWNED!! GIMME MY MONEY!!" bad bad shop person!!

ill keep up to date if something happens ... i think im gonna enjoy this..

When you bought the part, was there a Agreement of Terms paper or something that explains return policy? Because if they have it on paper, you can't do much. I have been to a couple of places where they only give you store credit. I know its a bunch of shit, but so are most of the laws today.

Thats pretty much what every auto / clothes store on the planet does. Just take the credit and use it to buy some dealer part that you need.

well yea, after they gave me the wrong part they gave me the receipt and it said on there no refunds no exceptions

but when they sell you something thats not for my car, take my money and then refuse to give me my money because they made the mistake and they dont have the right part to replace it with, then that overwrites the no exception rule.

thats like saying..."yes we have that... give us the money and we will give it to you, so you give them the money and then they say... ohh sorry.. HAHA we dont have it!!! , ohh here is the receipt saying that u gave us the money... oh and by the way, see it says no refunds, soo... haha this is how we make our money!! so think of something else you need"

that is bull crap, and ill tell him next week same thing im telling you guys, im not gonna let it stand... and fanatic, its better if you support me on this then tell me i cant do nothing about it, because it will get me more pumped up

You could possibly use the fact that they gave you the wrong part and can't ge the correct one to your advantage. Your best bet is to go to the Better Business Bureau. I am only stating facts to my knowledge. I don't want to fill you up with false hopes. That sucks worse than just knowing. Why can't they get you the correct hub? Just line something up with whoever you are pursuing this legal dispute with and offer the shop the chance to pay for the part you ordered from AZ. They'll probably bite if you threaten with court or BBB. Even if they win, a court battle doesn't look too good on your record whether you win or lose in something like this. Still can't argue with fine print.
