A letter to a liar!

Dear Mr. Williams:
Due to the fact that I was given false information on the car, I would like to request some compensation for the articles listed below:
1. Over the phone the first day I spoke with you, you told me that there was “an Integra LS” engine, also known as the B18a1. The engine that is in the car is a ZC DOHC non-vtec. The ZC was never in any Integra LS. Attached to this letter is proof that there was never an Integra LS with the ZC DOHC engine. The ZC DOHC was never released in America either; only through import can this engine be available.
2. You also told me that the body model was an HF model, which is lighter in weight, resulting in better gas mileage. The body for this car is a DX.
3. The front end of this car is supposed to be a Skyline front end. I have been told by the Manager of the impound company, and a few knowledgeable friends that this front end is a fake Skyline front end, and that a real Skyline front end would not fit on this car. Through research I have found that this is a very poorly attached replica R33 Skyline front end. I have had to re-attach this item twice since purchasing the car.
4. I was also un-aware of the ECU throwing a code 9. (This means the No. 1 cylinder position) As a result I will need to purchase a new distributor to fix this problem. Acura of Mission Viejo has informed me that this piece alone is at least $300.00. You told me that there were no mechanical problems other than the clutch.
5. I was also told that this car comes with Corvette floor mats, which were removed from the vehicle before I bought it.
When I first spoke to you on the phone you told me that you were looking for $5,600.00 for the car. A couple days later I went out to see the car and was told you now wanted $5,800.00 for the car. Then you increased the price again to $6,000.00 including the amp, which on AutoTrader.com you listed came with the car. In our contract we agreed my truck (as is), which was valued at over $4,000.00 according to Kelly Blue Book, and $3.400.00 in monthly installments, for the car, but decided the price would not include the amp, which was removed from the car.
Through giving me incorrect and false information about the car, it is my opinion that our contract is now null and void until we have come to an agreement which we feel is best suited for both of us in this situation.
In the following I have stated what I feel is a fair compensation for the issues stated above:
All I am asking for in compensation is the Alphasonik amp that was taken out of the car. If you can return that piece to the car, I will be happy to ignore the previously listed issues and continue to make payments, promptly and on time with no further issues.
If you feel that this statement is invalid or false, I feel I would be forced to file this through small claims court in order to resolve the situation in a timely, and fair order.

I'm sorry i didn't understand from your other thread; but you actually thought that it was a REAL skyline bumper on the car?
But if I were you i'd at least have him give you the floormats and pay to get the alternator fixed along with giving you the amp. Or at the very least knock off $450 to replace the floormats and and the alternator (and install). But that's just me.

get some money taken off the payments too... claim that the LS engine is worth much more than a ZC engine.. tell them the mount kit itself is worth as much as the ZC engine... say that you had a buyer setup for the mounts and swap for 1500 bucks...
that should get you some money taken off the total cost so that you wont be toooo ripped off

i would have also told him that ur taking money off the payments to replace the broken things (distributor and front bumper) and its his fault for not telling you, also, even though the distributor may be 300 at the dealership, just get one off e-bay for like 80 bux, but tell him u paid 300 plus tax :) let us know how it all works out

So I dropped the letter off at his house with his dad, he was not home. I am in the shower getting ready for work and he calls my cell phone and leaves me a message saying something along the lines of...
"I got your letter here, and i will gladly take you to court. I am taking the car back, the pink is in my name, your trucks pink is in my name, you messed up with this little letter here."
he goes on to tell me how he told me it was an integra engine. Never saying anything about how he told me previously that it was an LS engine.
So he thinks he is gonna reposess the car because i called him on his lies. I don't think he can legally do that... but we shall see.. I gotta find a nice attorny to tell me what exactly I can do for this...
Any suggestions on what to do? I guess I will have to take him to court.
I dunno why he got so pissed off about it...

save the message and lie about knowing it is a JDM intega engine...besides...itz not a usdm engine...and he would get the car from me...itd be sitting in storage until the situation is handled

I would be storing the car in a friends garage until this goes to court or is resolved.
and if he comes over with the police and ask where the car is just state it not on your property. and if he asks where the car is, just say this is a personal matter between me and mr.XXX to be resolved in court.

I agree with Kunundrum, unless you have something on paper that he signed, and perferably dated, it's your word against his, and both of you are going to loose something (court costs, whatever) because it will get messy.
Store the car somewhere that is blocked off, or in a fenced in locked lot, or blocked by other cars so there's no way it can be moved. And perferably not at your property.
If you spend money on the car, save all reciepts.

If this comes out to not be in your favor in the end, I'd take a sledge to the car and say you hit a bunny or something LOL. Its not like its your car anyway if the pink is in his name. Or tell him the car got stolen.

If he infact will reposses the car, just take stuff off of it and sell it. If the actual invintory of the equipment was never on paper, he gets the stiff.

HAHA yeah man. I've got almost a full HF interior sitting in my basement. Seats and all, just dont have the dash. I'll give it to you for free just to dick this asshole over. I mean he did say it was an HF before, so it should have an HF interior right? Nice blue/gray seats, good for throwing up on.

for all those saying he has no proof, he does...kinda. if there is any paperwork on the truck that points you as the previous owner then it's a no brainer to figure out some sort of trade went down. the question is: can you provide paper on the truck?

If you did fill out the papers for the titel transfer, did you make sure you wrote down an amount on the rear of the paperwork? if there is no amount, he can claim that you willingly gave him the truck for free, as a gift.

Any statements made about what was in the car form a part of that contract. Lying about it is fraud and you should have no trouble setting things right.

If the next call he gets is from your attorney he will crawl back to you asking to straighten things up. Nothing else will work. I have not talked to him since he gave me that letter because we went to my girlfriends house for the fourth of july. The courts are closed today so i can't get ahold of an attorny. Someone at worked told me to nail this guy for harassment cause he has called me about 40 times in the last 4 days or so...
But I am going to see if i can hire an attorny to help me handle this situation.
The letter is so nice because i didn't want to piss this guy off.... but obviously he is a fuck ass... so i will have to see if an attorny can help me.
I don't think he can reposess the car without any reason to... he can't repossess it because i caught him lying..
As far as the sale of the car to me, there is a cotnract that says "My truck and 3400 for his CRX" says nothing about the car specs though , just my 98 ranger for his 88 crx. All the car specs were verbally givin' to me.

Damn your in a pretty tough situation. He might own the title still and everything, but if you guys agreed to him selling you the car and you paying in payments then he cannot claim the car stolen. However though, he still owns the title making him have liability for the car. So here's what you can do if you want to fuck him over since he's gonna fuck you over. Just go and strip the car!!! It's been done before trust me. Yeah it might seem like insurance fraud but it's not legally your car. He will be liable for any parts that have been taken. So you wont have to pay for them. Just hide the parts somewhere else besides your house. And then tell him to come and take the car back.

This is the best thing to do now. But I have to say it, man. A 1998 vehicle traded for a 1988 vehicle. What are you smoking? It should have been a straight trade no money involved. Think about it. That "fuck ass" as you call him made out pretty good for himself. You gave him your truck so he had some reliable (?) wheels to get around in, not to mention you're giving him payments so that he has money to put gas in it. And you have a 16 year old car with a nice paint job, nice seats, nice wheels and needs tuning. Good luck...
