Re: Court action taken against PayPal- Question for any of you PayPal users out there...

Is it just me,or is the whole idea of 'jumping on the bandwagon' completely wrong?

Did any of you actually lose anything as a result of the alleged offence?

Acutally, when I bought an engine off of ebay and this ho didn't ship it, I contacted paypal, and after 10 days they CONCLUDED that the engine wasn't shipped and refunded me 15% of my $600.

I went to my bank and disputed the transaction and now paypal is giving me shit for getting MY OWN money back saying that it wasn't them who didn't ship the engine but the seller.

They're crooks. I reminded them they they got a chunk of that money because they take whatever percentage out and they haven't responded yet.

Sounds weird. I just joined the other day. I hate to give out any kind of personal info over the net. But, they have an 800#, they are a pretty large company. So we'll have to see.

I have never had trouble with them, so I won't give trouble -to- them. Probably because of the fact that I have never dealt with a product over $300 with them.

the only info you give them is your address and phone #, so they have that anyways. plus i'm moving my bank account in a few days to a different bank so they won't be able to fuck with that.

i think it did say somewhere in the letter that the lawsuit was filed in 2001 or something like that, so that old artice is probably right.

That's what I originally thought too- I've never even used the service in the several years I've been a member (never even transfered any funds into the account) so I have absolutely no concern with the company anyways. But they're still setting aside 1 Million regardless, and the monies will be dispersed equally amongst the participants (whether there's 200 or 200,000.) So one more person jumping on board isn't going to cost PayPal anymore, hell, it'll take that much more money away from another person with an equally unwarranted claim.

At any rate, the whole thing is still in the courts, so it's not like I'm counting my money and earmarking it for some important payment (for all I know, the shares could end up being dispersed as pocket-change due to so many claims.) I figure, they have my personal information/Debit card number anyways, so I don't really have much to lose sending in a claim with my info on it.

Except maybe your dignity and your self-respect.

Class action suits are the very worst of lawyering...especially when you yourself admit that they've done you no wrong.

Anyway, this is kind of ironic. I just bought a $100 item from ebay a couple of months ago and had to return it because it was deffective. No big deal, right? When I got the refund, PayPal withdrew the money from my PayPal account and tried to send it back to my debit card which is basically my bank account. They said it can take up to a month, at the most.

Well, it's been a month and a half and I still haven't received the money.

Now because of their mess up, I have to PROVE to them that I didn't receive the money, like I'm trying to steal their money. I didn't even authorize them to transfer the money back, I actually wanted them in my paypal account. I have to go back to my last few bank statements, explain the whole situation in a letter and fax it to them. On top of that, I've had to make several phone calls regarding this issue.

I already work hard for my money. I shouldn't have to WORK to keep it from being taken by PayPal.

I second that and agree with everything Mr. T says.

"9. WHAT IF I WANT TO EXCLUDE MYSELF (OPT-OUT) FROM THE SETTLEMENT?
If you do not want to remain a member of the class and participate in the settlement, then you must mail or deliver (email is not considered adequate), such that it is RECEIVED on or before September 7, 2004, (1) an original written, signed request for exclusion to Co-Lead Counsel at the following address:

Co Lead Counsel:
PayPal Class Action Settlement
A. J. De Bartolomeo
Girard Gibbs & De Bartolomeo LLP
601 California Street, Suite 1400
San Francisco, California 94108
and (2) a copy of the written signed request to PayPal's counsel at the following address:

PayPal's counsel:
PayPal Class Action Settlement
Morgan Lewis & Bockius LLP
One Market
Spear Street Tower
San Francisco, California 94105
This request for exclusion must contain your name and address; be signed by you; and include the reference "In re PayPal Litigation, Case No. CV-02-1227-JF (PVT)."

If you exclude yourself from the class, you will not participate in the settlement and cannot receive any payment from the settlement. Your claims will not be released."

- This is directly from my email. If I were to play the whole "principle of the thing" game, then technically, they have done me wrong. They've inconvenienced me by requesting that, should I decide NOT to enter into the claim, then I'm required to mail TWO seperate letters declining involvement. It's like they're setting it up so it's less of a hassle if I decide to actually opt IN.

Not that any of this matters much, since I've already decided (upon reading into the whole thing early this morning) that I'm just gonna toss the email anyways. I've never had any good experiences with legal stuff in the past, and generally suffered more hassle as a result of involvement. On the other side of it, they can screw if they think I'll waste the time and stamps to send them a letter.

Plus the stupid email is taking up 78 kb's in my inbox, and when it comes to a hotmail account, nothing says hassle more than a crappy 2mb limit that always comes up WAY to quick.

They WANT you to be a part of this settlement. If you're not a part that means that later on you can sue them for more money.

The only reason they're paying people who had nothing to do with this settlement is so they can't sue them later on, that's all.
