need lots of help with Sunfire problem?

I just purchased a 2003 sunfire with 101300k. As soon as I picked it up the check engine light came on(after the fact I found out that the dealer(owner) has a scanner which can delete the code and I figure he knew it was there.He changed the gas cap after it came up with a 440 code.I have been going bck and forth with him for 3 weeks to get it fixed, including emails with invites for drinks and lunch from him. I almost feel like hes giving me conditions on him repairing it. I am up in the Toronto Ont. area, I have talked to the UCDA and they can do mediation with issues like this to try and get him to fix but I need to present the guy an estimate, these emission things seem to be a real pain to trace and a major expense for me to eat, when this guy should be on the hook for it.I have had an independant mechanic scan and he got a 440 code then he scanner with a Tech2 and was getting no response from the vent solenoid, the purge solenoid was good.If I get the vent solenoid fixed could this rectify it or could it still be more that I should test. My independant mec. can not do the smoke test, should that be done? Any input would help, I wish I could nab this guy good.
