New Car With Mileage
So I found a new 2010 V6 Premium Mustang that looked good for $21,000. However, there aren't many 2010's left so it was at another dealer and had to be delivered. After we agreed on the price the dealer calls me at home and says it has about 200-300 hundred miles from test driving. I say fine...kind of angry, but not that big of a deal.
But today I got a call to come pick it up...but oh yeah, it actually has 1,000 miles on it. I was looking for some advice on what to do. I'm really pissed because in my book 1,000 miles is not new...and there is no way that those are from just test driving, which is what he claims. Should I: 1) Haggle a better price...and if so, how much better? 2) Get the warranty extended. 3) Walk away. Oh, and I'm wondering if what the dealer is doing is legal/unethical. I heard in some states that driving a car as a demo (which I'm assuming is what they did) without a title is a no-no. And if it has been titled before, it can't be sold as new. I'm buying in Kansas if that makes a difference. Any help would be appreciated! This is my first new car and i don't want to get screwed over. Thanks. |

You are correct, imo. 1000 miles is not a new car. This car has been used and has depreciated accordingly. You signed a contract for a NEW car. They are NOT giving you a NEW car, so they are in BREACH of your sales contract. So the contract is null and void. You probably can get out of the contract, or demad they supply a new car, or get some money off It's your choice, but you will have to fight for it. (Dealers are usually shifty scumbags, imho)
I am pretty sure they will threaten you with losing your deposit, unless you take this 'used' car. Don't fall for this. Consumer and contract law is entirely on your side. But how much has this used car declined in value? Compare your situation to that of a leased Mustang. A typical lease is 3 years and 50, 000 mile allowance. This means you are allowed 1388 miles a month, before you pay a penalty. Therefore, 1000 miles equals about 3 weeks of finance or lease payments. So, find out what that dealer advertises as monthly finance payments, including all fees and taxes. For example, if payments are $500 a month, then 3 weeks equals about $350. Therefore, the dealer should deduct $350 from the bill. (But imo, demand for $500 off) |
