Need help with a ticket in Indiana...
Anyone from Indiana...maybe even Delaware County....I got a ticket for going supposivly 85 in a 55...I myself know I was not doing this, but I can't say that and get off...I was wondering what my options were...
Ive been researching a lot of different things.... radar detection and the rules that cops must follw when using them and the calabriation(SP)...Anyone tried this and gotten off the hook... What is this no contest thing....am I still going to get points on my license or is it up to the judge? What happens if i plead not guilty and they find me guilty...do i just pay the additional court costs and the ticket...or can make me pay the ticket, court costs, and in addition to that, can they find me guilty of wreckless driving too and tack on other charges...? Also anyone know where to go and find out how many points this is going to be on my license? Indiana's sites suck and don't tell you anything. |

first of all. you should be aware of what speed your going no matter what.

I found a few web pages for point systems. They all said you would get 6points on your license and that it would be up to the judge if you got your license suspended (anything over 25mph is worthy of it they said). I am not sure of how trust worthy these sites are though so I would go to this one http://www.in.gov/bmv/contact/
and email them with your question on points. From my experience in GA here are the best options, remember advice is worth as much as you pay for it. If he clocked you, did you ask for a calibration check? If he "paced" you, you are much better off. meaning he followed you to determine how fast you were going. If this is the case generally cops have to have their cars speedometer tested on a regular basis but this costs money and time so they don't always do it. If they didn't do it generally you can get out of your ticket by fighting it. If he clocked you I would recommend getting in touch with some one called the "solicitor" at the court location. This is generally the person who is going to represent the state or county. Tell them, if this is one of your first tickets, that you have a good driving record, are willing to go to defensive driving school, and pay the fine if they are willing to drop the speed and severity on your ticket to a lesser value, maybe not even put it on your record. I got a ticket going 25 over in GA when I was under 21, which means automaticly losing your license for 6 months. I did this with the recommendation of a friend. I ended up paying the fine, going to drivers school, and doing 24hrs of community service but it isn't on my record. Good luck and sorry for the war and peace. |

Ill let you know that i have gotten my fair share of tickets. I sadly have considerable knowledge in this field. You say you weren't going that fast, that is understandable. Don't try the whole gun or speedo not callibrated because i promise you the officer will say in his police report that both were properly callibrated before use. The only way you will get off is if you did the right thing when you got pulled over. Did he ask you if you knew how fast you were going? What did you say in reply? If you said XX speed that is the lowest you will ever get, if you said not sure, i don't know ect, then medigate the ticket and they will lower it considerably. Thats about it.

Thanks for all the help....I'm just going to pay it and be happy they didnt give me reckless driving and do defensive driving course...not gonna risk having to pay more money because i lost in court...
