parked car hit/totalled - by non insured

My sister's parked malibu just got hit and totalled out sat. night by two guys that are both out on parol. The car was on the street and went airbourn and ended up 80 from its starting point into a neighbors yard. Neither has a drivers license - the car was somebody elses - taken w/o permission. My sister is now getting way less back for this car than what she owes. She's being screwed. Is there anything she can do now - these people have no money, no jobs, etc.....

ok..

Simple, tell your car owner that it's not your fault and it's parol's fault since they're the ones who did the damage, you shouldn't be paying for it.

I suggest you to forgive them in court, but ask the judge to sent them to rehabilation center to make them a better person. Once they become a better person and have a job, they should be able to pay you back. Sending them back to prison doesn't change who they are, it promotes their old-self.

I disagree.. they are obviously no good to society, being repeat offenders and having not learned their lesson the second time around they do not deserve anther chance to hurt society. Therapy, I'm sure was offered their first time in prison, if it didnt work then why send them back? It all goes back to recidivism. To the question at hand, sorry man, sis is outta luck.

I hear that the driver was in ICU up until yesterday with a cop outside the door 24/7. i'm guessing he was escorted to the jail yesterday. I'm curious to find out what they will do with him - but nobody will share any details.
The other car that was parked and hit along with my sister's was an older accord and b/c of them just having liability, she's out a car and everything.
I think creeps like these should not get out of prison in the first place. OBVIOUSLY if this guy has been doing this kind of crap since way back when (he's been in trouble multiple times for abuse, driving w/ no license, etc...) he's going to continue to keep doing it again and again b/c he knows he'll get away with it. what a bunch of bull.

Well, welcome to the real world.... It's unfortunate but those who break the law know they can get away with things like this and that's why they do it. Our only protection against people like this is insurance that we have to pay for ourselves-- which it sounds like your sister has.
The pepole that hit the car are in a criminal law problem that is completely unrelated to the car damage problem. The police, along with the "system" will deal with this. You sister's problem(cost of the damages) is a civil one WHICH YOUR INSURANCE COMPANY MAY OR MAY NOT GO AFTER. Typically, if they see that it's throwing good money after bad, they may just settle with your sister under her collision or comprehensive damage claim and drop it from there.

Now, if your sister feels that she is not being treated fairly by her insurance company under the stipulations of her policy, she can get second opinions as to what the repair or replacement cost will be. After everyhing is settled and if she has still lost money, she can sue the driver of the other car in a civil suit (small claims court is best, usually less than $50). If the other person is found to be liable, a judgement will be issued against them. While she may never actually get her money, the judgement will be another thing hanging over that persons head.

The revolving door parole system is THE reason there is a crime problem.
(I'll jump off of the soapbox right there. I don't want to confuse any of the liberals with facts.)
Now to punish those two criminals as much as possible: Even tho you might not see any $$$$ right away, small claim judgments are renewable. If those bozos ever get real jobs you can have their paychecks garnisheed.

My sister IS taking them to small claims. Worth a shot.
The driver was taken to a hospital in another state b/c of how badly his hip was shattered - they are doing the surgery there. I hope he's in a lot of pain! This has been a big mess for her!!!

well I dont know about the laws in the state your in but in NC if she has insuarance she could sue her insurance company for the amount owed plus court and legal fees. They would also have to pay for a rental car untill she got another one or up to 14 days whitchever comes first.
