auke1, you have my sympathy. I've been rear ended, and I've also hit someone who pulled out in front of me in a 45mph and stopped in the middle of the road. Both accidents I could do nothing about, and both turned my life upside down for weeks. I don't doubt that you have whiplash. Necks aren't made to be snapped around. Have a doc check it out now while the ins. still covers it, as it will get worse for a few days and take weeks to subside. I can understand your want for a convenience payment. Car accidents can be an incredible hassle..one of the side-effects of my last accident was that I had to spend hours upon hours on the phone with various insurance agencies and car dealerships in a desperate attempt to find a new car. Of course this was during peak hours when they're open. So, at the end of the month I had gone 2.5 hours over my peak minutes, totaling an extra $70. This is in addition to the fact that my first car, my baby, has been totaled, and my neck aches, and I have to find a new car within 4 days, and I have to come up with a down payment, and I missed work, and I can't drive because of the painkillers and muscle-relaxers they're put me on, and etc. etc. etc. The best I can tell you is to settle down, and wait, though it's maddening that your life is seemingly ruined and the person whose fault it was isn't even suffering. It might work out for the best, and you're lucky you're not seriously injured.

To Bryan: I don't give a darn if the "poor mother" is struggling, because of her someone's life is turned upside down and someone could have been killed. Why shouldn't she be paying for it????? I don't care if she really is poor and struggling, she caused the accident, she caused the inconvenience, so don't go throwing her a pity party just becuase of her insurance rates. If she is hurting under her insurance costs, maybe she should try not running into people.
