Well first off, I wouldn't have argued with the cop, but that's just me being a pussy I guess
Anyways, I think it depends on where you are. Around here officers cant do a visual at night, so if he really didnt get you on radar, you may be able to get out of it this way. Other than that I cant see anything that you can really get him for except for maybe harrassment. Good luck though.
