i have seen a few early 4th gens peeling paint... it's worth a try as long as you don't pay a lawyer. it only cost $20 to file a small claims suit where I live. you don't have much to lose and a lot more to gain.... most judges will probably be more apt to judge in your favor if your car is more severely affected. but it is a severe problem, so if you can get him/her to understand that, you should go for it.
