That's a sticky one.
Perhaps there are other conventions/agreements entered into where the signatories do not have the practical authority to administer them.
As you say, either it needs a constitutional amendment to provide authority - otherwise it means that agreements entered into with "The US" aren't necessarily applicable or enforceable in individual states.
Really though, lawyers and cops should know this stuff about foreigners and consulates - surely.
