There is a transmission sensor on the transmission that allows the car to start in Park and Neutral.
Maybe that sensor has a problem. Check the Service Manual

When you say the car is not starting does it actually crank over or completely dead?

That kind of cancels the gear position selector inhibiter switch being the problem....actually my wifes NB has a similar problem in not starting when cold which we overcome by flicking the remote locking button but anyway as its still under warranty its going to the dealers. I figure its the fuel pump not priming but we will see what the dealers say.

Hey you know what, it could be that the remote key sensor is messed up also. A while ago when I replaced my remote key for a new one myself, the car would do the same thing until I installed the original chip in the remote key.
