Car: Pontiac Firebird
Model: 1995
My Location: Honolulu
Date of Purchase: A little under three months ago

I bought a Firebird from a dealership here for about $4000. It's been a little under 3 months since I bought it and I hardly drove the car. The head gasket is blown. Several repairmen have quoted me prices ranging from $1600-$2500 and most of them won't touch it because they say that it's like putting a bandaid on a gunshot wound. The dealer is giving me the run-a-round and telling me that he has no legal responsiblity to take the car back and that I need to hang on to the car for a while so that he can figure out if there's something that he can do to help me. I'm left hanging.

Does anybody here know my rights or have advice to offer??? I called some lawyers and so far they haven't expressed any interest in taking my case. Any thoughts?

Many thanks.

Jared

hey, im from honolulu meself. technically, the dealers right. as long as he sold the car 'as is' its your problem.. however if it was one of the bigger dealers, taking it to the press may help..

i guess it comes down to..

what kind of bird is it, is it worth it to fix it?

he said firebird so i am assuming it is a v6 but since it is a 95 it can be the 3.4 or the 3.8, hopefully the 3.8

Sorry to Rain on the parade, but-
Unfortunately, being you bought it used - most cars are sold " as is no warranty" That means it is up to you to thoroughly check it out "before" signing the sales agreement.
Unless you got it in writing that the dealer was going to fix anything that was wrong, - Im afraid you realyy dont have any recourse. and this is the very reason that you are having problems finding an attorney to take this on for you. They already know the odds of winning are against you because of the contract with Your Signature on it.

As a general rule most people trade cars in because there are problems that are going to be expensive to fix and they just dont want to spend more money fixing a problem greater than or equal to the blue book value of the car .

Just for reference here is a clip of the Kelly Blue Book Value assuming it is a V6 with a 3.8 in excellent condition:

Engine: V6 3.8 Liter
Trans: Automatic
Drive: RWD
Mileage: 100,000

Equipment
Air Conditioning
Power Steering
Power Windows
Power Door Locks
Tilt Wheel
Cruise Control
AM/FM Stereo
Cassette
Dual Front Air Bags
ABS (4-Wheel)
Alloy Wheels

Consumer Rated Condition: Excellent
"Excellent" condition means that the vehicle looks new, is in excellent mechanical condition and needs no reconditioning. This vehicle has never had any paint or body work and is free of rust. The vehicle has a clean title history is assumed. and will pass a smog and safety inspection. The engine compartment is clean, with no fluid leaks and is free of any wear or visible defects. The vehicle also has complete and verifiable service records. Less than 5% of all used vehicles fall into this category.

Trade-In Value $2,975
Trade-in Value is what consumers can expect to receive from a dealer for a trade-in vehicle assuming an accurate appraisal of condition.

What is the Lemon Law?

The Lemon Law is designed to protect consumers that purchase new cars, trucks, SUVs and mini-vans. As of 1993 all fifty U.S. states have passed Lemon Laws. Each state has different standards and procedures, but all have similar coverage.
