my car is fuked

last night i was driving in kingshighway,and suddenly i saw a SUV trying to turn to highway 44 from kingshighway ,but that dump ass insted of waitting for me to pass, just slamed in to my side.i tried to dodge him but he accelerator instead of braking. he hited me and i spun 2 times while all the pices of broken glasses hitting my face.i looked at my car and i saw half of my car is smashed.

You have got to be kidding. Dude, he was driving without insurance (illegal in every state that I know of) and hit you. First 2 people I would have called would have been the cops and your insurance company. Let the bastard take out a 2nd mortgage for all you care, he screwed up and should have to pay every dime.

you got the everything right except for the last part. it doesn't depend on your insurance company. they guy who hit didn't have insurance. that's illegal. IF he had insurance, it would pay for your car. even if he doesn't, he is still obligated to pay for your damages, and he will get a ticket/whatever for not having insurance. so, its still depends on him...and i don't know why you say "depends", because it IS his duty by law to pay for your damages.

ya, most likely you'll have to sue him or your insurance will sue him, but it will be much easier since 1) it was his fault, and 2) he has no insurance.

yea, i agree with whats been said. Talk to your insurance company about taking legal action against him. They may already be planning on sueing him for the damages, but ask him about it anyways. If you have a lawyer, give him a call as well. You may get lucky and your insurance company will go for punitive damages, in which they make an example out of him and fine him $$$$$ for driving w/o insurance. But probably not since your not injured.....hows your neck feel? lol

I think you might want to takee the money from your insurrance and let them have to hassle the other driver to get something out of him... But try to see if he has money or not, if hes really poor then you wont be able to get anything from him anyway... (ive even heard of people filing bankrupt becuase they didnt have insurance and wouldnt pay the person they hit!)

Holy crap dude, that really sucks. Make damn sure he pays up. Accidents can really screw you over. My mom hit a lady in an SUV a few years ago and she was only goin about 10-15mph in her yukon and my mom rear ended the lady. It was just bad enough that the lady needed a new rear bumper and my mom needed a new front bumper. So we called they insurance company and it turns out they never told us that our policy was expired and we had to renew it, so that means we had no insurance! So i guess the lady found that out a while later and she started complaining about her neck and back hurting and she kept going to the doctor and chiropractor and giving us they bills. After it was all settled we had payed in the range of 10 grand to that bitch. A month later she fucking sold the car that she was in the accident with. If i ever see her again i will fucking kill that bitch, then her family will have something to complain about.

but yeah, if your insurance will pay up and it wont affect your rates (which it shouldn't), just take it. that is unless you want to waste your time making it your personal business to see that this guy suffers. either way hes f-ed by the insurance company or you.

i bet they total out the car. Then buy it back from them for like 500 usually. Go find yourself another good body vr4, swap in your new engine and maybe tranny. Take everything else you want then part out the rest and you will have a nice car and prob make some money off the deal.
