Anyhow, so I told most of you about my ticket a while ago for the left turn from the right lane on a red cause people were being bitches and wouldnt let me merge? Anyhow, I am going through the mail and I got a "notice of correction" cause the cop forgot to put his serial number and name on the ticket. But he didnt sign the notice of correction, can I exploit this to my advantage?
So I was also reviewing the ticket and he said that he only put the red light violation on there and not the illegal lane change. WRONG, here is whats on the ticket.
First line: 21453CVC Turn on Red arrow
Here is a greater description of 21453 I found on the internet.
21453. (a) A driver facing a steady circular red signal alone shall
stop at a marked limit line, but if none, before entering the
crosswalk on the near side of the intersection or, if none, then
before entering the intersection, and shall remain stopped until an
indication to proceed is shown, except as provided in subdivision
(b).
(b) Except when a sign is in place prohibiting a turn, a driver,
after stopping as required by subdivision (a), facing a steady
circular red signal, may turn right, or turn left from a one-way
street onto a one-way street. A driver making that turn shall yield
the right-of-way to pedestrians lawfully within an adjacent crosswalk
and to any vehicle that has approached or is approaching so closely
as to constitute an immediate hazard to the driver, and shall
continue to yield the right-of-way to that vehicle until the driver
can proceed with reasonable safety.
(c) A driver facing a steady red arrow signal shall not enter the
intersection to make the movement indicated by the arrow and, unless
entering the intersection to make a movement permitted by another
signal, shall stop at a clearly marked limit line, but if none,
before entering the crosswalk on the near side of the intersection,
or if none, then before entering the intersection, and shall remain
stopped until an indication permitting movement is shown.
(d) Unless otherwise directed by a pedestrian control signal as
provided in Section 21456, a pedestrian facing a steady circular red
or red arrow signal shall not enter the roadway.
Also on the second line 22100 is written there but no text telling me what that code means, so I looked this up too.
22100. Except as provided in Section 22100.5 or 22101, the driver
of any vehicle intending to turn upon a highway shall do so as
follows:
(a) Right Turns. Both the approach for a right-hand turn and a
right-hand turn shall be made as close as practicable to the
right-hand curb or edge of the roadway except:
(1) Upon a highway having three marked lanes for traffic moving in
one direction which terminates at an intersecting highway
accommodating traffic in both directions, the driver of a vehicle in
the middle lane may turn right into any lane lawfully available to
traffic moving in that direction upon the roadway being entered.
(2) When a right-hand turn is made from a one-way highway at an
intersection, a driver shall approach the turn as provided in
subdivision (a) and shall complete the turn in any lane lawfully
available to traffic moving in that direction upon the roadway being
entered.
(3) Upon a highway having an additional lane or lanes marked for a
right turn by appropriate signs or markings, the driver of a vehicle
may turn right from any lane designated and marked for that turning
movement.
(b) Left Turns. The approach for a left turn shall be made as
close as practicable to the left-hand edge of the extreme left-hand
lane or portion of the roadway lawfully available to traffic moving
in the direction of travel of such vehicle and, when turning at an
intersection, the left turn shall not be made before entering the
intersection. After entering the intersection, the left turn shall
be made so as to leave the intersection in a lane lawfully available
to traffic moving in that direction upon the roadway being entered,
except:
(1) Upon a highway having three marked lanes for traffic moving in
one direction which terminates at an intersecting highway
accommodating traffic in both directions, the driver of a vehicle in

respect to highways under their respective jurisdictions, may cause
official traffic control devices to be placed or erected within or
adjacent to intersections to regulate or prohibit turning movements
at such intersections.
(b) When turning movements are required at an intersection notice
of such requirement shall be given by erection of a sign, unless an
additional clearly marked traffic lane is provided for the approach
to the turning movement, in which event notice as applicable to such
additional traffic lane shall be given by any official traffic
control device.
(c) When right- or left-hand turns are prohibited at an
intersection notice of such prohibition shall be given by erection of
a sign.
(d) When official traffic control devices are placed as required
in subdivisions (b) or (c), it shall be unlawful for any driver of a
vehicle to disobey the directions of such official traffic control
devices.
Am I completely screwed or is there the possibility of contesting?

I think you've got a decent case because the cop didn't properly fill out the ticket, and also didn't sign the notice of correction, as well as the fact that he doesn't even know what infractions he wrote you up for... That's probably more than enough to get the ticket dropped.

From what I've heard if you protest and get a court date and cop dont show, your case gets dropped instantly. So what my friend did before was reschedule a couple of times...I think that was the max in moving court dates..anyway, he made up some excuse and the 3rd time, cop didnt bother showing up and he got his ticket dropped. Only drawback, if you protest a ticket, you become ineligible for traffic school and if you lose, then its a point against your record.:D

I dont really want to contest it cause what I did was hella wrong and there is no way around it.
My dad told me to make up some sob story about traffic and the nervousness of commuting and all that kind of shit.
I am thinking if that doesent work, then bring up the ticket thing.
Also, I am thinking of pleading "no contest" from what I hear its kind of a half assed plea.

Well...kinda too late now. You should have given that excuse to the cop...I actually had gotten away with at least 3 speeding tickets for just being remorseful and accepting of the consequences, in other words, sucking up to the officer...Got 2 on my birthday (consecutive years) and 3rd a few weeks after. Didnt mean to rub it in...Good luck to you though whatever you decide on...:silly2:

I did suck up to the damn cop. I was the KING of avoiding tickets, I have been pulled over 6 times for other shit over the years and not one ticket. So now I got dethroned.
Anyway, from what I hear though, since my court date is on a friday, the judges, clearks, and all that shit are kinda cool cause they are all thinking about their weekend plans.

you really should try watch the way everyone else's case go. i have heard the resheduling thing working...but, i have also heard it not working.

yeah, my last ticket was 2 yrs ago...driving up on the Bay Bridge and not even speeding (going 60mph) but was ahead of a pack of cars. It was 7am on my way to play golf and driving my red Mercedes...I see this motorcycle speeding from behind and even said to myself, "if this bike doesnt slow down, he'll get tagged for speeding." Next thing i knew, it was a damn CHP with his blinkers right behind me...Tried to play that birthday excuse thing because it was literally 4 days before my birthday...didnt work and gave me a ticket(I wonder if he'd let me go if I was driving a beat up car and not a mercedes)... Anyway, but a month later, I get pulled over again, played the birthday excuse and got away...:D

One of my friends with an 89 SI with B16 was hitting 100 on the bay bridge at like 2AM, and he got pulled over, the cop was like "is there any good reason why you were driving so fast" and he was like "well these times we are in are so unceartin, I just wanted to get off the bridge before the terroists crash a plane into it!" The cop laughed and let him go.

LoL.... I believe if I were a cop, I would have let him off just for the originality of that one.

i got a ticket for loud exahust...I was just doing a left turn & I didn't see the cop behind me cuz it was night time. So he pulled me over & said.."so whose this car?" I said my mom's (she's got the title) so he said" so your mom bumps this car?" and I put the innocent face of not knowing anything...so he asked for all the paper work & then gave me a ticket. Got the paper work in the mail & gotta pay $10 & fix the loud exhaust noise. oh well, im gonna put my stock back & then put my modified one back, hehehe!!!!!:D
