I know there is a post about this and I checked it out but this is a different ticket with different circumstances. Alright, I'm going down a highway and I was trying to catch up to a friend. The speed limit was 55 and my ticket says I was doing 81 (26mph over, ouch) . Needless to say he through the book at me :nono: . He pulls me over and walks up to my window and says come sit in the cruiser. So I get out and give him all the nessessary info. He then proceeds to rip my ass because he though I was trying to get away from him because he flipped around and was stuck behind a truck and couldn't catch me and I then pulled over into the hospital. After explaining to him that there was no shoulder to pull over on and that he didnt even have his lights on yet he then asks me to sign the ticket. I asked him (since I was in his cruiser) to see the radar he picked me up on and he says he doesn't have it. He then tells me he won't let me go out of his car until he can call my parents. I say to him " No, i'm going to call them and let them know." So we somehow debate this issue on whether or not he can hold me there until he calls my parents. Eventuall he tries but they dont answer. He then accuses me of lying to him saying that I gave him the wrong numbers. Anyway he ends up finally letting me go with a $244 speeding ticket. ANY advice on this situation would be GREATLEY appreciated.

Well first off, I wouldn't have argued with the cop, but that's just me being a pussy I guess:rolleyes: Anyways, I think it depends on where you are. Around here officers cant do a visual at night, so if he really didnt get you on radar, you may be able to get out of it this way. Other than that I cant see anything that you can really get him for except for maybe harrassment. Good luck though.

Well I think you made a mistake arguing with him as well. The place where they pull you over, isn't the place to argue. If being polite and asking for a break doesn't work, arguing wont either. That is saved for court. Now you have probably pissed the cop off, and he is going to be alot less receptive to giving you a break when the court date rolls around. Plus if you really pissed him off, he will remember hte incident better and again be more likely to screw you over when you go to court.

With how many mph over you were, I'd consider getting a traffic lawyer. Chances are he never had you on radar, because at 30mph you usually lose your license, so if a cop knows you are flying, but didn't get you on radar, they usually go with 26-29 over the limit... Anyway, consider a lawyer, 26 over is alot of points, and could cost you your license later.
Remember, the $244 or whatever fine is nothing. It's the points that will cost you in future insurance costs.

We didn't really argue. I just kept asking him if he had to call my parents. I know there is not a law that says the cop has to call your parents for a freakin speeding ticket. I was polite the whole time. He was just a complete ass. For my previous tickets the cops were cool. He is also stationed in a town 45 miles away from here. (he was a state trooper) I don't know if this will make a difference in whether or not he will show. Anyway, this sucks.
