Unless there was a posted minimum speed limit, they would still be at fault.

Someone explain why its the garcia's fault the guy died? He wasn't the car that crashed into him, nor was he at fault for the other guy speeding. Everyone has the capability to think by themselves.
Don't get me wrong, i think it was wrong to be racing, but i just don't see why the other guy is being charged.

streetrcr45, that is the law in most places.
The guy who crashed could not have killed someone by street racing unless there was someone who was racing him -- both are guilty.
We have a HUGE trial going on in my city right now because a bad guy started a huge gun battle. He was shooting at uncover police. HE fired the first shot.
After the battle was going on, a uniformed officer showed up, misread the situation and shot and killed one of the under cover cops.
Even the a cop fired the lethal shot, the guy who started the gun battle is up on Murder charges.
It is HIS fault that people were firing guns and someone got killed.
Anyway, think about THAT the next time you street race.
Do you TRUST this unknown person in the other lane to handle their car and not kill someone?
Every time you street race, you are accepting potential felony murder/manslaughter charges for the actions OF THE OTHER DRIVER.
I don't know anyone I trust that much, much less a stranger in the other lane.

So if somehow they were proven to not be racing, or just happened to be speeding? then the charges would be dropped for the guy who didn't kill the man.
People speed on the highway all the time, its not uncommon to see at least two people going over the speed limit on the highway at any given time, so what justifies this as Streetracing?

I can see both sides of the argument, and both do have good points.
Yes, the death would not have occured if the two high schoolers were racing, but the victim should not have been on the road either, which would have obviously prevented the death as well.
As long as my wallet will let me, I will try to keep to the track more.

Actually under the law the second driver is responsible... its basically the same idea as if you were enticing somebody to rob a store, you would also be held accountable (I don't know about under the same charge though). Personally I'm all about taking responsiblity for one's self so the driver who actually hit the car and made the decison to race and keep racing is fully responsible.

This is the only thing I'm really worried about whenever I race. Once again you've got to watch for your own ass as well as the other person.
Not that it's %100 full proof, but if you choose to race only when there is no traffic, and good conditions etc. than can do a lot to prevent these things from happening.
If you come up on a corner for instance, and you know it could be lethal then maybe think about slowing down for it instead of leading the person your racing into a situation they might not be able to handle. If your in traffic just refrain from racing altogether.
No one here (that races now) will stop racing after hearing about the story so the least you can do is evaluate the race before hand. Just my :2cents:
