i bought a head off ebay and paid through paypal. the seller said he sent out the item but i never got it. it turned out that the package was damaged so bad, ups decided to send it back to the shipper. so the seller got a messed up head and the money i paid him. he said he tossed out the head since it was broken and wont give me the money back. i told my bank that i never recieved the item so they got my money back from paypal, but that put my paypal account in negative. i told paypal what happend and they got me $175 and they said thats all they can do. now paypal has sent the rest of my debt to a collection agency and they are not helping me get the rest of my money from the seller. i dont think i should have to pay for it since i never recieved anything, and paypal should go after the seller or at least help me out with what i can do. will this mess up my credit? what can i do to get my money back form the seller?

Contact paypal and tell them the whole situation, after that start talking to a lawyer or something and see what your options are.

I'd start off by making it right with Paypal. They didn't do anything wrong in all this, they paid the seller. It's the seller that owes you for the merchandise, not Paypal. I'd just be glad they were able to get you something back.

yea the seller is the one that owes the money, then why isn't paypal going after him? and therye supposed to have that buyer protection program for up to a grand, i read all their terms and conditions and i met it, so thats why i thought i was protected, but then they come up with some excuse why its not covered.

What was their excuse for not covering it all? You said you got back 175; what was the full purchase price?

they said that the seller didn't have a paypal symbol next to their seller id so it wasn't covered, but on their terms, it didn't say anything about it. it just said that i have to buy it off ebay, the paypal has to be the one in the ebay auction and not another one, and it had to be a physical product and not a service. the final price was 1150. paypal said that they will do what they can to get the money back, and the seller only had 175 in his acct so they took it and requested him to give me a refund which he won't. so both our paypal account is locked. so the only way this goes away is if the seller give me a refund or i pay paypal, which i am not going to cause im not going to get screwed over twice.

I think the actual item doesn't matter, the fact that he isn't getting what he wanted for the advertised price is the issue.
