Need legal advice

Ok PLEASE HELP ME. my girlfriend and her ex made a sex tape and he may have made a copy because it sounds just like her on his cell phone and he gave the tape back 2wks before he got his phone. I left a message telling him on his phone that if it is her im going to turn him into the cops for it because he did not have her consent and i want to know if he can get into trouble for it and if so how can i get him in trouble for it.

You are very much out of luck I think. Are you sure she didn't consent?(she may not be totally honest about it) The cops won't do anything. The best you might be able to do is get a cut from the profits(if he even tries to make money on it) in civil court. Might help if you would explain the story a little more.

ok she told him she wanted all the tape back and all the copys if there was any. so he gave it back and he told her that it was the only tape and there was nothing else now his phone has what really sounds just like her i know it sounds like her because she has moaned the exact way with me. She even told him not to dub the tape or recored her voice. We both swear its her.

Did he have consent when he made the vid though? I believe that would give him sole rights to it.

they made it together and it was hers he barrowed it when the were still together and was suppose to give it back when he did he promised her that it was the only copy and nothing was taped or recoreded from it. Wouldnt this make it illegal?

not unless she has some rights to it. as far as the laws are concerned if he's not trying to sell it then it doesn't mean shit to them.

No copyright. I don't believe she has any legal right over the contents at all. I know it sucks, but if you don't believe me just talk to a lawyer. I may have a college degree, but I only took six hours of law. :lol2:

Also, your state may have laws protecting this kind of thing. Only a lawyer in your state would really know.

It isn't between him and her anymore. You need to stay involved. she is your gf now. He may use it to manipulate her. Support her all the way if you think she is worth it.

Try to convince her not to talk to him at all. If you are civil about it, he will probably just give you the tapes. Keep in mind that he is most likely just using the tapes as leverage. When he sees that he going to have to keep dealing with you instead of her, he might not want to keep the tapes anymore.

good news he gave her the website he recored it from its a pron site. I swore it was her though but its just another girl god he had me scared becuase he wouldnt tell her if it was or not he said he was embarrased where he got it from

ya im so happy its not her i made my girlfriend give me his phone # since he wouldnt tell her where that clip came from. I gave him a call and told him i would kick his ass if it was my g/f. He gave me the site and its a porn site and one of the things u can do is download things like that. I know its not her because you are not able to put things on there your self.
