dont lug nuts have to approved by the dot to be sold for highway use? I would say, buy the ones that are DOT approved.

You should have at least a full nut and somewhere around 100ft/lbs of torque. Is this about the wheel spacers that we were talking about a few months ago? If so, adding spacers and moving your rim towards the end of the studs will make them much more likely to snap. You would be much safer getting the ones that bolt on with the existing studs and lug nuts and then have new studs for the wheel to mount on. Like these:
