I heard from my mom that my dad, was just involved in a little accident this evening. He was in his '04 545i sport when he was at a stop sign, and someone rear-ended him. My mom said his car was deemed not drivable so....I don't know what's next. I will try to get pics, and keep you posted.

Fuck it, you don't want that car now. It'll never be the same if they try to fix it.

Dad's home, well and doing fine, no injuries, he looks like what he does everyday lol. Damage report on the car: rear axle and tire bent, that was why the car was not drivable. It was towed back to the Dealer, and will be evaluated.

Well, a luxury car is probably one of the safest cars to be involved in an accident with. Glad to hear your dad's OK. Let's see some pictures.

If he doesn't want it, I'll reluctantly take it off his hands as a farm car.

My dad didn't give the right terminology I don't think, because he told me earlier today if he was going to get a new car and he said "pfft, no, they're going to fix it," so I don't think he meant it when he said "rear tire and axle bent." like I said, we will see. My sister also I heard said that the lady ran the stop sign, and nailed his tail where the wheel was, almost like a t-bone but in the rear, I don't know, I will clarify though.

Ok, Here's an update. My dad was t-boned on the right rear side when the lady in an SUV and on the phone ran a stop sign. The skidmarks, and other clues lead the cop to even say that the lady was at fault and my dad was not. So his rear suspension, and tires, and axle all need to be replaced, which will all be covered. THe problem is, the part that is required won't be here for another 5 or so months.......There's alot to replace on thatcar particularly, because the drivetrain is rear wheel drive, and the rear suspension was damaged.
Not only that, the lady didn't report the accident and compulsively lied to the officer saying that it was my dads fault when evidently it was her fault (on the fone, ran a stop sign). As much as my parents hate it, if she fails to report the accident.....they see a possible law suit in sight...as much as they hate it....it maybe the only option left...
here's a basic diagram.

Make sure you go to the crash site and get lots of pics of skid marks and such. And make sure you PWN her ass in court. Cause shes a jackass.

The cop has that all taken care of because he said on the spot that it was all her fault, and offered to help defend my dad when it got to court

Instead of making a new thread about this topic, thought I'd bring an update.
Dad got his 545i back, looks great and brand new, but there's a few things wrong. Car doesn't quite feel the same on bumps, rear right door rattles when closed, road noise is alot more noticeable in the right reear seat, and there's a bigger gap between the rear right door and the body c-post compared to the other side. It's good that he got his car back, but like everyone said, no car is the same after being wrecked.

I wouldn't hate to sue someone if they were trying to go around the law(not reporting) which was caused from doing something else illegal(running stop sign, and talking on the phone should be illegal).

As long as it drives the same its ok. The tolerances around the door may be difficult to achieve. The car is probably completely fine, your just getting more noise from outside and the door isn't perfectly hung.

sounds like some serious damage to chassis - what did the mechanics say about it?

The chassis is fine, otherwise they would have given him a new car. It was just the rear suspension unit and the right rear body that was damaged.

No, it's not. If the door doesn't hang right, and looking at how he got hit, the chassis/unibody/subframe/whatever is out of whack and the car should have been totalled.
Trust me, I'm stuck with a fucked up car cause the insurance company said it was only $758.05 to fix, any estimate I got was >$1k. My suspension is tweaked, bumper's fucked, unibody off-set. I was rear-ended straight on by a paseo doin 40mph and no brakes, I was stopped. If he got t-boned by an SUV then the car's trash, man.
What's the update on the law suit?

The lady finally decided to report it, thus no suit is needed. My dad said it took her 2 weeks to report it.....take long enough . In the end they gave him back the car, they repaired the body and suspension unit, but I guess the damage wasn't bad enough to replace the car. He might go back to the body shop to have it looked it. I assume he's stuck driving it unless it goes under the lemon law or something. I really don't know. WE'll just have to see. I couldn't get any pictures because it was at the shop the whole time and my dad didn't have the time to take me just to take pictures, a little bit waste of time.
